A. Rough Grading and Improvement Plans for Tract 8112, THE RESERVE AT <br />PLEASANTON prepared by Carlson , Barbee & Gibson, Inc.; Revised Bond Estimate <br />for Tract 8112, dated June 19, 2012 and subsequent revisions to the plans, prepared by <br />Carlson , Barbee & Gibson, Inc. and approved by the City Engineer and <br />B. Landscaping and Joint Trench Plans for Tract 8112, THE RESERVE AT <br />PLEASANTON prepared by and <br />and approved by the City Engineer on <br />3. Responsibility under NPDES Permit. Subdivider will work as either an "Approved <br />Signatory" or a "Legally Responsible Person" (LRP) for Tract 8112 in reference to the NPDES <br />General Permit for Storm Water Discharges Associated with Construction and Land Disturbance <br />Activities. Subdivider shall perform all tasks required in that permit, including, but not limited <br />to, the following items A -E, below: <br />A. File Notice of Intent (NOI) prior to commencement of construction activity. <br />B. All tasks related to said permit shall be in coordination with the Tract 8112 QSD,. <br />C. Submit all "SWPPP's Revisions ", "Annual Reports ", etc. to State Water Resources <br />Control Board or other information required by the above mentioned permit or <br />requested by the Regional Water Quality Control Board, State Water Board, US EPA <br />or Local Storm Water Management Agency. <br />D. Any additional costs charged for work under this Agreement by the Regional Water <br />Quality Control Board, State Water Board, US EPA or Local Storm Water <br />Management Agency shall be paid by Subdivider. <br />E. File Notice of Termination (NOT) in reference to State Construction General Permit <br />and act as a "Approved Signatory" or LRP until the permit has been approved as <br />completed and its measures deemed fulfilled by the applicable State regulatory <br />agency and post - construction storm water management measures have been installed. <br />4 Inspection. City shall inspect all of said work through an inspector employed by City at the <br />cost and expense of Subdivider, and Subdivider shall pay City the cost of such inspection as <br />fixed by Ordinance. The City Engineer has tentatively fixed the inspection costs due upon <br />execution of this Agreement as follows: <br />$ 42,690.00 <br />5. Soils Report. Subdivider has provided a soils report as required by Government Code <br />§ §66490 et. seq. prepared by and dated <br />6. Plans. All of said work shall be done and materials furnished in strict accordance with the <br />approved plans for said tract filed with the City Engineer, and in accordance with the standard <br />specifications and details of the City of Pleasanton. It is further understood that the work and <br />materials shall be under the supervision of the City Engineer, and performed and installed to his <br />satisfaction. <br />Subdivision Agreement - Tract 8112 Page 2 of 7 <br />
