ATTACHMENT 4 <br />REIMBURSEMENT AGREEMENT FOR <br />EXTENDED WATER AND SEWER IMPROVEMENTS <br />This Reimbursement Agreement for Extended Water and Sewer Improvements <br />( "Agreement ") is entered into on , 2012, between the City of Pleasanton, a general <br />law city ( "City") and Toll Bros., Inc., a Pennsylvania Corporation ( "Developer "). <br />RECITALS <br />A. Developer has an interest in certain real property located in the City of Pleasanton, <br />County of Alameda, State of California, commonly known as 1689 Vineyard Avenue consisting <br />of approximately 18 acres (the "Property "). After the Property received approval for the planned <br />unit development plan designated as PUD -06, pursuant to Ordinance No. 1834 adopted by the <br />City Council of the City Pleasanton on June 19, 2001, as amended, Developer has obtained <br />approval of a vesting tentative map for a nineteen (19) lot single - family, detached residential <br />development designated as Tract 8112 ( "Project "), approved by the City's Planning Commission <br />by Resolution PC- 2002 -43 adopted on July 10, 2002 (which approval was for 7'ract 7385, of <br />which Tract 8112 is a subsequent phase of that earlier tract). <br />B. As provided by California Government Code §66485 et. seq., in connection with the <br />development of the Property, Developer intends to construct or cause to be constructed extended <br />water and sewer systems that contain approximately two hundred feet (200') of supplemental <br />length in order to facilitate future connection at a water connection point and sewer manhole, <br />respectively, for future development of 1666 Vineyard Avenue in Pleasanton (the "Benefitted <br />Property ") as described and shown in the attached Exhibit A incorporated herein by this <br />reference (the "Improvements "). <br />C. Pursuant to Condition of Approval No. 9 of PC- 2002 -43 ( "Condition of Approval "), <br />the Developer was required to install the Improvements and has requested reimbursement from <br />the Benefitted Property. <br />D. Pursuant to the Subdivision Map Act (California Government Code § §66410, et seq.) <br />and the Condition of Approval, Developer is entitled to reimbursement for that portion of the <br />costs of the Improvements, including amounts attributable to interest and administration costs, in <br />excess of the construction costs required for the Project ( "Reimbursable Costs "). City agrees to <br />administer the reimbursement of costs to Developer as set forth in this Agreement. <br />NOW, THEREFORE, it is agreed as follows: <br />Section 1. Improvements. The Improvements to be constructed, installed and financed by <br />Developer will benefit the Benefited Property. The Benefited Property has the one (1) existing <br />home and the potential to have three (3) new single family homes pursuant to the City's Vineyard <br />Avenue Corridor Specific Plan, adopted by the City on June 1, 1999, as amended, and when the <br />1 <br />
