Attachment 1 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON REGARDING SETTLEMENT AUTHORITY FOR GOVERNMENT CLAIMS AND WORKERS' COMPENSATION CLAIMS AGAINST THE CITY OF PLEASANTON WHEREAS, Government Code section 935.4 authorizes cities to adopt resolutions providing settlement authority to City employees over claims filed under the Government Claims Act; and WHEREAS, the City Council of the City of Pleasanton has previously adopted Resolution No. 78-207 regarding the resolution of government claims; and WHEREAS, Government Code section 949 provides the governing body of a local public agency may compromise or delegate to its attorney or an employee to compromise any pending action; and WHEREAS, the City Council is desirous of increasing the efficiency of the claims processes used by the City of Pleasanton by providing specific settlement authority to the City Attorney and the City Manager. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Resolution No. 78-207 is hereby repealed. SECTION 2. The City Attorney is authorized to settle government claims up to $25,000. SECTION 3. The City Attorney, with the advice and consent of the City Manager, is authorized to settle government claims against the City up to $50,000. SECTION 4. The City Council reserves to itself the power and authority to resolve any government claims against the City in excess of $50,000, and to resolve all claims brought in the name of the City, regardless of the amount in controversy. SECTION 5. The City Attorney is authorized to settle Worker's Compensation claims up to $50,000. SECTION 6. The City Attorney, with the advice and consent of the City Manager, is authorized to settle Workers' Compensation claims against the City up to $100,000.
