Attachment 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> REGARDING SETTLEMENT AUTHORITY FOR GOVERNMENT CLAIMS AND <br /> WORKERS' COMPENSATION CLAIMS AGAINST THE CITY OF <br /> PLEASANTON <br /> WHEREAS, Government Code section 935.4 authorizes cities to adopt <br /> resolutions providing settlement authority to City employees over claims filed under the <br /> Government Claims Act; and <br /> WHEREAS, the City Council of the City of Pleasanton has previously adopted <br /> Resolution No. 78-207 regarding the resolution of government claims; and <br /> WHEREAS, Government Code section 949 provides the governing body of a <br /> local public agency may compromise or delegate to its attorney or an employee to <br /> compromise any pending action; and <br /> WHEREAS, the City Council is desirous of increasing the efficiency of the claims <br /> processes used by the City of Pleasanton by providing specific settlement authority to <br /> the City Attorney and the City Manager. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. Resolution No. 78-207 is hereby repealed. <br /> SECTION 2. The City Attorney is authorized to settle government claims up to <br /> $25,000. <br /> SECTION 3. The City Attorney, with the advice and consent of the City <br /> Manager, is authorized to settle government claims against the City up to $50,000. <br /> SECTION 4. The City Council reserves to itself the power and authority to <br /> resolve any government claims against the City in excess of $50,000, and to resolve all <br /> claims brought in the name of the City, regardless of the amount in controversy. <br /> SECTION 5. The City Attorney is authorized to settle Worker's Compensation <br /> claims up to $50,000. <br /> SECTION 6. The City Attorney, with the advice and consent of the City <br /> Manager, is authorized to settle Workers' Compensation claims against the City up to <br /> $100,000. <br />
