CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 985 <br /> <br /> O~RDINANCE REZOi]ING ONE ACRE LOCATED AT 5130 <br /> FOOTHILL ROAD FRO~i A (AGRICULTURAL) TO <br /> R-l-40,000 (SINGLE-FAMILY RESIDENTIAL) DISTRICT <br /> <br />WHEREAS, Billy R. Newnam applied to have an approximately 5.1 <br /> acre site located at 5130 Foothill Road rezoned from <br /> A (Agricultural) to R-I-40,000 (Single-Family <br /> Residential) District; and <br />WHEREAS, based on the Initial Environmental Study indicating <br /> no significant adverse effects on the environment, <br /> a negative declaration ~as adopted by Council on <br /> July 28, 1981; and <br /> <br />WHEREAS, Council received the Planning Commission's recommenda- <br /> tion for approval of the rezoning; and <br /> <br />WtlEREAS, a duly noticed public hearing was held on July 14, <br /> 1981; and <br /> <br /> ~{EREAS, City Council upon review of the application finds that <br /> the applicant's intent could be accomplished by rezoning <br /> only one acre of the property, which would also eliminate <br /> the possibility of the property being subdivided in the <br /> future on land which evidence indicates may be unstable; <br /> and <br /> <br /> WtlEREAS, City Council finds that this rezoning is consistent with <br /> the General Plan policies of the City of Pleasanton. <br /> TI{E CITY COUNCIL OF THE CITY OF PLEASANTON DOES ~REBY ORDAIN AS <br /> FOLLOWS: <br /> Section 1: Approves the rezoning of a one acre parcel containing <br /> the existing residence located at 5130 Foothill Road <br /> from A (Agricultural) to R-i-40,000 (Single-Family <br /> Residential) District. <br /> Section 2: The Zoning MaD of the City of Pleasanton dated <br /> April 18, 1960, on file with the City Clerk, designating <br /> and dividing the City into zoning districts is hereby <br /> amended by Zoning Unit Map ~-225, attached hereto as <br /> Exhibit A dated July 14, 1981, and incorporated herein <br /> by reference. <br /> <br /> <br />
