RESOLUTION NO. 12-524 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND BRE PROPERTIES, INC., AS FILED UNDER CASE NO. PUD-81- <br /> 30-86D. <br /> WHEREAS, Pleasanton Municipal Code Chapter 17.40 (adopted by Ordinance No. <br /> 1488) sets forth a Lower Income Housing Fee requirement to support an affordable housing <br /> program which authorizes the City to enter into regulatory agreements with developers to exempt <br /> projects from the lower-income housing fee if a project provides fifteen percent (15%) of its <br /> residential units at affordable levels; and <br /> WHEREAS, BRE Properties, Inc. has made an application to the City for an Affordable <br /> Housing Agreement for the construction of a mixed-use, high-density residential/commercial <br /> development located at the northern corner of Gibraltar Drive and Hacienda Drive, filed under <br /> Case No. PUD-81-30-86D; and <br /> WHEREAS, the Pleasanton Housing Commission at its meeting of November 17, 2011 <br /> reviewed and recommended approval of the Affordable Housing Agreement; and <br /> WHEREAS, a duly noticed public hearing was held by the City Council on April 17, <br /> 2012, at which time the public was given the opportunity to comment on the Affordable Housing <br /> Agreement; and <br /> WHEREAS, the City Council considered all the information presented at the public <br /> hearing regarding the terms of the Affordable Housing Agreement. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the proposed Affordable Housing Agreement between the City of <br /> Pleasanton and BRE Properties, Inc., is consistent with the City's General Plan and the objectives <br /> of the Lower-Income Housing Fee Ordinance and the City's affordable housing polices. <br /> SECTION 2. Approves the Affordable Housing Agreement between the City of <br /> Pleasanton and BRE Properties, Inc., a copy of which is attached hereto as Exhibit A and <br /> incorporated herein by this reference; and authorizes the City Manager to execute the <br /> Affordable Housing Agreement in generally the form attached as Exhibit A. <br /> SECTION 3. This resolution shall become effective upon the effective date of the <br /> ordinance approving the PUD development plan and development agreement amendment for <br /> this project. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 17, 2012. <br /> 1 <br />
