RESOLUTION NO. 12-541 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, APPROVING THE GENERAL PLAN AMENDMENT TO AMEND PROGRAM 9.7 AND POLICY 37 OF THE GENERAL PLAN HOUSING ELEMENT, AS FILED UNDER CASE P12-0754 WHEREAS, after the adoption of the Housing Element on February 13, 2012, Urban Habitat, one of the Plaintiffs in the Urban Habitat et al. v. City of Pleasanton litigation sent the City a letter on Feb. 15, 2012 and requested that the parties meet and confer regarding the City's obligation under the August 2010 Settlement Agreement; and WHEREAS, the parties have met and conferred and arrived at a mutually satisfactory resolution of the matters raised in the Feb. 15, 2012 letter; and WHEREAS, the terms of that understanding are set forth in a separate letter of agreement that followed Urban Habitat's letter of February 15, 2012; and WHEREAS, the terms of that separate letter of agreement involve two modifications to the Housing Element adopted February 13, 2012; and WHEREAS, on May 9, 2012, the Planning Commission held a public hearing on the proposed amendments to the Housing Element and made a positive recommendation to the City Council; and WHEREAS, a Supplemental Environmental Impact Report (SEIR) was prepared for the Housing Element Update project, and the City Council adopted a resolution certifying the SEIR as complete and adequate in compliance with the California Environmental Quality Act on January 4, 2012; and WHEREAS, the amendments described in Exhibit A are minor changes to the Goals, Policies and Programs and are consistent with the Housing Element project as described and analyzed in the certified SEIR and no further environmental assessment need be conducted; and WHEREAS, a duly noticed public hearing was held by the City Council on June 5, 2012 with respect to this General Plan Amendment. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: SECTION 1. The General Plan Amendment to amend Program 9.7 and Policy 37, as shown in Exhibit A, attached hereto and made part of this resolution by reference, is hereby approved. SECTION 2. The City Council determines that this is the second of four times in 2012 that the Housing Element of the General Plan may be amended as provided in Government Code Section 65358. SECTION 3. This resolution shall become effective immediately upon its passage and adoption.
