BACKGROUND <br /> In October 1978 the City and Caltrans entered into a Freeway Maintenance Agreement <br /> (FMA) for the maintenance of 1-580 and the connecting roadways. The agreement <br /> includes provisions to amend the agreement when future improvements or minor <br /> revisions are planned within the area included in the original agreement. An amended <br /> FMA was executed in July 2003 allowing the City of Dublin to reconstruct the north side <br /> of the interchange at San Ramon Road. These improvements were completed by the <br /> City of Dublin. <br /> A Landscape Maintenance Agreement (LMA) was executed in Spring 1999 for <br /> interchange landscape maintenance on the south side of the 1-580 eastbound off-ramp <br /> adjacent to the existing Marriot Residence Inn property. As a condition of approval for <br /> the Marriot project, the City required the property owner to install and maintain <br /> landscaping within Caltrans right of way. Since Caltrans prohibits LMA's with private <br /> property owners, the City entered into an agreement with Caltrans for landscape <br /> maintenance. The City then relied on a separate agreement with the property owner for <br /> maintenance of the landscaping. <br /> DISCUSSION <br /> Caltrans requires an amendment to the existing FMA prior to approval of an interchange <br /> improvement project. The new Foothill interchange project is fully designed and <br /> awaiting Caltrans final approval. The amended FMA does not change the roles or <br /> responsibilities for maintenance of any facilities that were established in the 1978 <br /> agreement. With the exception of minor improvements at the freeway ramps and <br /> nearby striping improvements, Foothill Road will not be significantly modified by the <br /> interchange project. Amending the existing FMA will appropriately reflect the <br /> improvements. <br /> Caltrans has requested a new LMA for the Foothill Interchange that will replace the <br /> existing 1999 LMA. The City will continue to assume landscape maintenance <br /> responsibility for the Caltrans right of way south of 1-580. This is very similar to the <br /> current agreement, changing the area of landscaping slightly due to roadway <br /> realignment. The Foothill Interchange project will replace existing landscaping impacted <br /> by interchange construction activity, although the project is not scoped or funded to <br /> provide additional landscaping. The City has expressed to Caltrans an interest in future <br /> landscaping improvements at the interchange. This LMA will allow the City to design <br /> and construct these improvements in the future. The new LMA will not affect the existing <br /> agreement between the City and adjacent private property owner. <br /> Page 2 of 3 <br />
