CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 978 AN URGENCY ORDINANCE AMENDING ORDINANCE NO. 954 SECTION 2 CHANGING EFFECTIVE DATE TO AUGUST 25, 1981 WHEREAS, the City Council of the City of Pleasanton adopted Ordinance No. 954 (An Ordinance Amending Title V (Vehicles and Traffic), Chapter 5 (Commercial Vehicle Regulation) by Adding Article 2 to Prohibit Overweight Vehicles from Certain Roads) on January 27, 1981; and WHEREAS, Section 2 of the ordinance ordained that said ordinance would take effect thirty (.30) days after its passage and adoption; and WHEREAS, the City Council of the City of Pleasanton on February 6, 1981 adopted as an urgency measure Ordinance No. 960 extending the effective date of Ordinance No. 954; and WHEREAS, the City of Pleasanton has entered into discussions with the gravel companies under the auspices of a federal district court judge to try to reach a solution to the problems created by overweight vehicles on First Street and Sunol Road in the City of Pleasanton short of litigation. NOW, THEREFORE, THE CITY COUNCIL OF Tt~ CITY OF PLEASANTON ORDAINS AS FOLLOWS: Section 1: Section 2 (Effective Date of Ordinance) of Ordinance No. 954 (Amending Title V, Chapter 5, by Adding Article 2 to Prohibit Overweight Vehicles from Certain Roads) is hereby amended to read as follows: "Effective Date of Ordinance. This ordinance shall take effect on August 25, 1981." Section 2: Declaration of Urgency. The City Council makes the following findings of urgency: (!) The City of Pleasanton has adopted Ordinance No. 954 prohibiting vehicles weighing in excess of 16,000 pounds from using certain roads in the City of Pleasanton. (.2) Said ordinance will take effect on June 26, 1981 unless its effective date is extended. (3) Should the ordinance go into effect on June 26, 1981, long and costly litigation would undoubtedly
