CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 978 <br /> <br /> AN URGENCY ORDINANCE AMENDING ORDINANCE NO. 954 <br /> SECTION 2 CHANGING EFFECTIVE DATE TO AUGUST 25, 1981 <br /> <br />WHEREAS, the City Council of the City of Pleasanton adopted <br /> Ordinance No. 954 (An Ordinance Amending Title V <br /> (Vehicles and Traffic), Chapter 5 (Commercial Vehicle <br /> Regulation) by Adding Article 2 to Prohibit Overweight <br /> Vehicles from Certain Roads) on January 27, 1981; and <br /> <br />WHEREAS, Section 2 of the ordinance ordained that said ordinance <br /> would take effect thirty (.30) days after its passage <br /> and adoption; and <br /> <br />WHEREAS, the City Council of the City of Pleasanton on February 6, <br /> 1981 adopted as an urgency measure Ordinance No. 960 <br /> extending the effective date of Ordinance No. 954; and <br /> <br />WHEREAS, the City of Pleasanton has entered into discussions with <br /> the gravel companies under the auspices of a federal <br /> district court judge to try to reach a solution to the <br /> problems created by overweight vehicles on First Street <br /> and Sunol Road in the City of Pleasanton short of <br /> litigation. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF Tt~ CITY OF PLEASANTON ORDAINS <br />AS FOLLOWS: <br /> <br />Section 1: Section 2 (Effective Date of Ordinance) of Ordinance <br /> No. 954 (Amending Title V, Chapter 5, by Adding Article 2 <br /> to Prohibit Overweight Vehicles from Certain Roads) is <br /> hereby amended to read as follows: <br /> <br /> "Effective Date of Ordinance. This ordinance shall <br /> take effect on August 25, 1981." <br /> <br />Section 2: Declaration of Urgency. The City Council makes the <br /> following findings of urgency: <br /> <br /> (!) The City of Pleasanton has adopted Ordinance No. <br /> 954 prohibiting vehicles weighing in excess of <br /> 16,000 pounds from using certain roads in the <br /> City of Pleasanton. <br /> <br /> (.2) Said ordinance will take effect on June 26, 1981 <br /> unless its effective date is extended. <br /> <br /> (3) Should the ordinance go into effect on June 26, <br /> 1981, long and costly litigation would undoubtedly <br /> <br /> <br />
