WHEREAS, the Council began deliberation and Councilmember Sullivan <br /> continued the appeal to the next regular City Council meeting on May 15, 2012; and <br /> WHEREAS, the City Council held a public hearing on May 15, 2012, at which <br /> time the City Council allowed a member of the public provide additional testimony, and <br /> the City Council, after a review of the materials presented, determined that the issuance <br /> of the Zoning Certificate was consistent with the General Plan, zoning code, and PUD <br /> regulations for the site. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. Denies the appeal, thereby upholding the decision of the Planning <br /> Commission to deny the earlier appeal (Ms. Joe-Willmes and Ms. Martin) thereby <br /> upholding the Community Development Director's approval of Case No. P12-0113 <br /> (Zoning Certificate), the application of WalMart Neighborhood Market for zoning <br /> approval to operate a food market in an existing building with limited hours of operation <br /> and limited delivery hours as a permitted use at 3112 Santa Rita Road. <br /> SECTION 2.
