Call special meetings. <br /> D. The vice chairperson shall preside in the absence of the chairperson. <br /> E. The city manager shall appoint a city employee to serve as staff liaison who shall <br /> also serve as secretary to the commission. The staff liaison/secretary to the commission <br /> shall keep true and accurate accounts of all action of the commission. <br /> b. Amend Tile 5 Business Licensing and Taxation, Section 5.04.010 Definitions, <br /> subsection C, as follows: <br /> C. "Collector" shall mean the department director responsible for management of the <br /> city business license activities or that director's authorized assistants. <br /> c. Amend Section 5.12.030 (Evidence of doing business) as follows: <br /> 5.12.030 Evidence of doing business. <br /> When any person: (a) by the use of signs, circulars, cards, telephone books, internet or <br /> newspapers, advertise, hold out or represent that the person is conducting business in the city, <br /> (b) holds an active license or permits issued by a governmental agency indicating that the <br /> person is conducting business in the city, or (c) makes a sale, takes an order, delivers goods as <br /> a private carrier to any destination within the city, renders a commercial service or performs any <br /> similar act within the city, such facts shall be considered prima facie evidence that the person is <br /> conducting business in the city. This includes, but is not limited to, persons who use a <br /> Pleasanton address for licensing by federal, state or other public agencies, even if business is <br /> done off-site out of Pleasanton. <br /> d. Repeal in its entirety Chapter 6.16 Drug Paraphernalia. <br /> e. Amend Chapters 9.04 Noise Regulations and 18.84 Site, Yard, Bulk ... as <br /> follows: <br /> Add a new 9.04.078 Pool equipment, as follows: <br /> 9.04.078 Pool equipment <br /> A. Pool equipment shall be operated in compliance with the noise limits as specified in this <br /> Chapter based on where the pool equipment is located (i.e., residential property, commercial <br /> property, industrial property, etc.). <br /> B. Pool equipment shall be field tested under operating conditions by the administrative <br /> authority for noise limit compliance prior to final approval of pool installation. Testing shall be by <br /> a sound level meter as defined in this Chapter. <br /> C. Where pool equipment noise limit compliance is not achieved, said equipment shall be <br /> relocated, otherwise adjusted/altered, or an enclosure for noise attenuation installed to achieve <br /> compliance prior to final approval of pool installation by the administrative authority. <br />
