• Ordinance No. 2035 approving a Planned Unit Development plan to construct a mixed-use <br /> high-density residential/commercial development containing 251 residential units, 4 live/work <br /> units, and approximately 5,700 square feet of retail space at the property located at the <br /> southeast corner of Owens Drive and Willow Road, as filed under Case No. PUD-85-08-12D <br /> • Ordinance No. 2036 approving a Planned Unit Development plan to construct a mixed-use <br /> high-density residential/commercial development containing 247 residential units, 4live/work <br /> units, and a .55-acre public park at the property located at the northern corner of Gibraltar Drive <br /> and Hacienda Drive; as filed under Case No. PUD-81-30-86D <br /> • Ordinance No. 2037 approving amendment to Phase 1 and Phase II Development Agreements <br /> between the City of Pleasanton and Prudential Insurance that would extend for five (5) years the <br /> term of the agreement from the date of approval of the two Development Plans filed under Case <br /> Nos. PUD-85-08-12D and PUD-81-30-86D; and (b) incorporate approval of the development <br /> standards and design guidelines of the Hacienda Transit Oriented Development (TOD) <br /> Standards and Guidelines filed under Case No. P11-0856 <br /> • Resolution No. 12-522 approving a Mitigated Negative Declaration for the application of BRE <br /> Properties, Inc., as filed under Case Nos. PUD-85-08-12D and PUD-81-30-86D <br /> • Resolution No. 15-523 approving the affordable housing agreement between the City of <br /> Pleasanton and BRE Properties, Inc., as filed under Case No. PUD-85-08-12D <br /> • Resolution No. 15-524 approving the affordable housing agreement between the City of <br /> Pleasanton and BRE Properties, Inc., as filed under Case No. PUD-81-30-86D <br /> • Resolution No. 15-525 approving Growth Management Agreement for PUD-85-08-12D and <br /> PUD-81-30-86D, Mixed-Use High-Density Residential/Commercial Developments, and <br /> authorizing the City Manager to execute the agreements. <br /> Motion passed by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> BREAK: Mayor Hosterman called a brief recess and reconvened the meeting at 9:39 p.m. <br /> 18. Public Hearing: PADR-2090, Rodney and Trina Lopez (Appellants and Applicants) — Considered <br /> an appeal of a Planning Commission decision denying modification of Condition No. 8 of City <br /> Council Resolution No. 11-420 regarding a skylight approved by Administrative Design Review for <br /> additions totaling approx, 1,118 sq. ft. at 6114 Homer Court (Continued from April 3, 2012) <br /> Mayor Hosterman said that the item, which is essentially a neighborhood dispute, is an excellent <br /> example of why the Council needs to consider reforming the appeals process. <br /> Councilmember Sullivan disagreed, stating that this is a very important process and he was very <br /> interested in hearing the appeal. <br /> Mr. Dolan presented the staff report, stating that the applicants/appellants received approval for a <br /> second story addition to their single-family residence. The Council's approval contained a condition <br /> requiring the applicant to provide $2,500 for the purchase and installation of a skylight to the neighbors <br /> immediately to the east who were most impacted by the project. Staff interpreted this condition to mean <br /> City Council Minutes Page 9 of 13 April 17,2012 <br />
