BACKGROUND <br /> The 1987 federal Clean Water Act requires that storm water discharges from municipal <br /> storm sewer systems obtain coverage under a nationwide surface water runoff permit <br /> program called the National Pollutant Discharge Elimination System (NPDES). Any <br /> storm water discharged from the storm drain system (including roads with drainage <br /> systems, catch basins curbs, gutters, ditches, manmade channels, etc.) is required to <br /> have NPDES coverage and to comply with the conditions of the permit. <br /> In 1991, seventeen agencies in Alameda County, made up of fourteen cities and three <br /> districts, determined that the most cost effective way to implement program <br /> requirements was to work together through a coordinated countywide storm water <br /> program. As a result, all parties entered into an agreement establishing the ACCWP to <br /> implement the required municipal storm water NPDES permit and to establish that the <br /> parties will work collaboratively and cost effectively regarding storm water issues. In <br /> October 2009, the Regional Water Board reissued the NPDES permit for ACCWP and <br /> expanded it to integrate other newly adopted programs. This new permit is called the <br /> Municipal Regional Permit or MRP. <br /> In response to the October 2009 changes and the new MRP, a workgroup made up of <br /> the ACCWP members reviewed and reassessed MOA that has resulted in a new <br /> recommend MOA that looks to address the following objectives: <br /> 1 . Improve equity by making changes in the allocation of ACCWP's costs. <br /> 2. Improve equity by making changes to voting shares. <br /> 3. Increase flexibility of the Program's operations by allowing parties other than <br /> Alameda County to take on the role of program manager. <br /> 4. Increase flexibility of the ACCWP's operations by allowing member agencies to <br /> act as fiscal agent. <br /> 5. Improve clarity by adopting a new stand-alone agreement that incorporates the <br /> changes described above as well as a number of minor additional changes to <br /> reflect current conditions. <br /> The new recommended MOA is now being circulated to the member agencies for <br /> approval. <br /> Page 2 of 4 <br />
