CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> ORDINANCE NO. 569 <br /> AN ORDINANCE AMENDING ARTICLE 20 , ORDINANCE NO. 520 <br /> (ZONING ORDINANCE) BY ADDING SECTION 20 . 101, RELATING <br /> TO TEMPORARY USES <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br /> AS FOLLOWS : <br /> I . <br /> Article 20 , Ordinance 520 , is hereby amended by the addition <br /> thereto of Section 20 . 101, dealing with temporary uses, said <br /> section to provide as follows : <br /> "Section 20 . 101. Temporary Uses <br /> A temporary use in an existing structure may be permit- <br /> ted in a "C" District , for not to exceed one year where <br /> it appears by specific finding made by the Planning <br /> Commission that : <br /> (1) The temporary use is proposed only pending appli- <br /> cation for rezoning to accommodate a permitted or <br /> conditionally permitted use . The permit may be <br /> conditioned upon the filing of such application. <br /> (2) The temporary use, even though not permitted or <br /> conditionally permitted, is not so inconsistent <br /> with the regulations for the district in which <br /> it is located as to constitute a traffic hazard <br /> or parking problem, or to create noise, odor, or <br /> other conditions offensive to the senses , or to <br /> be inconsistent with adjoining land uses . <br /> The permit may be revocable or granted subject to <br /> such conditions as the Commission may prescribe . <br /> Conditions may include , but shall not be limited <br /> to, requiring that no structural alterations be <br /> made to the structure in order to accommodate the <br /> temporary use; requiring street dedications and <br /> improvements; requiring any or all of the con- <br /> ditions specifically allowed in Article 24 or <br /> Article 25 , of Ordinance 520 . <br /> The City Council may elect to review a decision <br /> of the Planning Commission as described in Sec- <br /> tion 1 . 110 hereof, or a decision of the Commis- <br /> sion may be appealed to the City Council by the <br /> applicant or by any other person as prescribed in <br /> Section 1. 111 hereof. An appeal shall be heard <br /> and acted upon as described in Sections 1 .112 and <br /> 1 . 113 hereof. " <br />
