Public Comment <br /> Lee Fulton said it was recently brought to his attention that a provision of Measure QQ has not been <br /> implemented. He read from Measure QQ, specifically as it pertains to the collaborative development of <br /> ordinance/design guidelines regarding the southeast hills no later than November 2009. Given that at <br /> least three major developments are slated for the southeast hills, he asked that the City move forward <br /> with this requirement and volunteered to take part in the implementation process. <br /> PUBLIC HEARINGS AND OTHER MATTERS <br /> 9. Public Hearing: UP-90-43/PCUP-273, George Mull (Appellant) — Consider an appeal of a <br /> Planning Commission decision modifying the existing Conditional Use Permits for the operation of <br /> Club Neo located at 4825 Hopyard Road, Suite F10 <br /> Community Development Director Dolan presented the staff report, stating that Club Neo occupies <br /> approximately 10,750 square feet in Gateway Square on the corner of Stoneridge Drive and Chabot <br /> Drive. He reviewed site maps and floor plans, noting that while the facility has a Hopyard Drive <br /> address, no entrances or outdoor areas face Hopyard. The facility consists primarily of two bar areas, a <br /> VIP area, and office and food preparation areas. <br /> The City originally approved a nightclub use at this location in 1990, with occupancy of 643. In 2010, <br /> the City processed and approved an application to increase total occupancy to 812 persons based on <br /> the successful history of this use at the location and the new operator's extensive experience in <br /> City Council Minutes Page 2 of 6 April 3, 2012 <br />
