EXHIBIT A-1 <br /> CONDITIONS OF APPROVAL <br /> PUD-85-08-12D and P11-0856 / Site 1, BRE Properties, Inc. <br /> Mixed Use Development Project <br /> April 17, 2012 <br /> PROJECT SPECIFIC CONDITIONS <br /> Planning Division <br /> 1. Revised plans related to the depth of live/work spaces, dated "Received, March <br /> 27, 2012," on file with the Planning Division, shall be further revised to reflect a <br /> live/work depth of 38-feet for "Building H1" and 40-feet for "Building G4." The <br /> setback for `Building H1" shall be a minimum of 16-feet from the curb on Owens <br /> Drive. The applicant shall submit elevations and exhibits to the satisfaction of the <br /> Director of Community Development demonstrating how the extended first floor <br /> spaces integrate with overall architectural design. These revisions shall be <br /> subject to the review and approval of the Director of Community Development <br /> prior to building permit issuance. <br /> 2. The subject property is zoned Planned Unit Development — Mixed Use (PUD-MU) <br /> District. The permitted and conditionally permitted uses on the subject property <br /> shall be those listed on page 13 of the Hacienda TOD Standards and Design <br /> Guidelines. <br /> 3. The development plan (Case No. PUD-85-08-12D) and the Phase I and Phase II <br /> Development Agreement Amendments (Case No. P11-0856) shall expire five <br /> years from the effective date of this ordinance unless a building permit is issued <br /> and construction has commenced and is diligently pursued. <br /> 4. At the time a building permit is issued, the development approved with this PUD <br /> development plan will replace the assigned Hacienda office and commercial <br /> square-footage capacity for this site. <br /> 5. The applicant and/or developer shall submit a pad elevation certification prepared <br /> by a licensed land surveyor or registered civil engineer to the Chief Building <br /> Official and Director of Community Development certifying that the pad elevations <br /> and building locations (setbacks) are pursuant to the approved plans, prior to <br /> receiving a foundation inspection for the structures. <br /> 6. The applicant shall construct 8-foot of paved area and 2-foot of landscaping for <br /> the proposed trail along the east side of Site 1. These improvements shall be <br /> shown on the plans submitted to the Building and Safety Division for plan check <br /> and permit issuance.
