BACKGROUND <br /> This omnibus ordinance and resolution amending the Pleasanton Municipal Code and <br /> Master Fee Schedule is an annual process to present minor and non-controversial <br /> changes to the Pleasanton Municipal Code and Master Fee Schedule. These matters <br /> are generally so small in nature that a stand-alone City Council agenda item to correct <br /> or amend them is not warranted. <br /> DISCUSSION <br /> This proposed omnibus ordinance and related resolution are for the following: <br /> Chapter 2.32 Parks & Recreation Commission — In 2000, the City Council adopted Ord. <br /> 1819 with the intent of making all City commissions organized in the same manner. <br /> This included allowing commissioners to serve a maximum of two consecutive full one <br /> year terms as chairperson of their commission. (SR 00:335.) However, an error in the <br /> ordinance only allowed for one term by the chairperson of the Parks & Recreation <br /> Commission. The proposed ordinance would correct this error in §2.32.070 <br /> (Organization) to allow two consecutive full terms, consistent with the Human Services, <br /> Youth, Planning, Library, Housing, and Civic Arts commissions. <br /> Chapter 5.12 [Business) License and Tax Payment — The proposed amendment of <br /> Section 5.04.010 (Definitions) clarifies the "Collector" function as having changed from <br /> the Finance Department to currently Economic Development, and updates Section <br /> 5.12.030 (Evidence of doing business) to clarify application where home office is base <br /> for offsite business operations. Chapter 5.12 currently references fees as being in the <br /> Master Fee Schedule, when such fees have previously not be included therein. The <br /> proposed resolution puts into the commonly available Master Fee Schedule the fees for <br /> business licenses, limited reports allowed per Section 5.08.050 (Information <br /> confidential), and fees to recover minimum administrative costs for license changes. <br /> Chapter 6.16 Drug Paraphernalia — The proposed ordinance repeals Chapter 6.16, as <br /> any display or sale of drug paraphernalia is prohibited by State law. The existing <br /> Chapter 6.16 was adopted in 1980 (Ord. 922) and mirrored 1980 State law. However, <br /> in 1982, State law changed to prohibit the display or sale of drug paraphernalia', but the <br /> Municipal Code was never amended to reflect that State law change. This amendment <br /> to repeal Chapter 6.16 will eliminate any confusion and be consistent with State law. <br /> Chapters 9.04 (Noise) and 18.84 (Site, Yard, Bulk, Usable Open Space and <br /> Landscaping Regulations) for Pools and Spas - The former Municipal Code Chapter <br /> 20.40 "Swimming Pools" was deleted as part of several code amendments to adopt the <br /> 2010 California Building Code (Ord. 2015). However, former Sections 20.40.130 <br /> "Location" and 20.40.135 "Noise Attenuation and Enclosures" had zoning-related <br /> regulations that are proposed to be added back to Chapter 9.04 (Noise) and Chapter <br /> 18.84 (Site, Yard ...) to address pool and spa location and equipment noise. <br /> ' Cal.
