RESOLUTION NO. 12-522 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE APPLICATION OF <br /> BRE PROPERTIES, INC., AS FILED UNDER CASE NOS. PUD-85-08-12D AND PUD- <br /> 81-30-86D <br /> WHEREAS, at its meeting of April 3, 2012, the City Council received a proposed <br /> Mitigated Negative Declaration for the application of BRE Properties, Inc. for two Planned Unit <br /> Development (PUD) development plan approvals to construct: (a) a mixed-use high-density <br /> residential/commercial development containing 251 residential units, 4 live/work units, and <br /> approximately 5,700 square feet of retail space at the property located at the southeast corner of <br /> Owens Drive and Willow Road (PUD-85-08-12D); and (b) a high-density residential development <br /> containing 247 residential units, 4 live/work units, and a 0.55-acre public park at the property <br /> located at the northern corner of Gibraltar Drive and Hacienda Drive (PUD-81-30-86D); and <br /> WHEREAS, the City Council received and reviewed the Initial Study, dated February 28, <br /> 2012, and received the recommendations of the staff and Planning Commission; and <br /> WHEREAS, a duly noticed public hearing was held on April 17, 2012. at which time the <br /> public was given the opportunity to comment on the environmental impacts of the proposed <br /> projects; and <br /> WHEREAS, the City Council has reviewed the potential impacts in accordance with the <br /> applicable state and local guidelines governing the preparation of the Mitigated Negative <br /> Declarations; and <br /> WHEREAS, the City Council finds that the proposed projects would not have any <br /> significant adverse effects on the environment. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. The Mitigated Negative Declaration for the applications of BRE Properties, <br /> Inc. for two Planned Unit Development (PUD) development plan approvals to construct: (a) a <br /> mixed-use high-density residential/commercial development containing 251 residential units, <br /> 4 live/work units, and approximately 5,700 square feet of retail space at the property located at the <br /> southeast corner of Owens Drive and Willow Road (PUD-85-08-12D); and (b) a high-density <br /> residential development containing 247 residential units, 4 live/work units, and a 0.55-acre public <br /> park at the property located at the northern corner of Gibraltar Drive arid Hacienda Drive <br /> (PUD-81-30-86D), is hereby approved. <br /> SECTION 2. The City staff is directed to cause a Notice of Determination to be filed <br /> pursuant to Section 5.4(g) of Resolution No. 77-66. <br /> SECTION 3. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 17, 2012. <br />
