17.36.080 <br /> b. The city council may adjust the suballocation of units among the "major project" and "first-come, <br /> first-served project" categories to retlect actual or projected activity among these two categories. <br /> Such a reallocation may be made by the council at the annual review or a periodic review of the <br /> growth management program as described in Section 17.36.050 of this chapter.(Ord. 1999§ 1,2009; <br /> Ord. 1729§2, 1997) <br /> 17.36.080 Approval procedures. <br /> The procedures which are prerequisites for obtaining a building permit are set forth in this section for each cate- <br /> gory of project. <br /> A. Affordable Housing Project.A qualifying project developer must first receive a specific allocation for the number <br /> of units and years in which the units shall be built from the affordable housing project suballocation established <br /> in Section 17.36.070(13)0)of this chapter. <br /> I. Availability of Building Permits to Affordable Projects. <br /> a. Initial Suballocation and Carry-Over. The affordable housing project suballocation shall be initially <br /> available in the year it first appears. If not used,or partially used, the unused units shall be added to <br /> the following year's affordable housing suballocation, and all unused units shall continue to carry <br /> over to succeeding years in the event they are not fully used. <br /> b. Use of Future Years' Suballocations. In addition to utilizing the existing year's suballocation(includ- <br /> ing any units carried over from prior years), a qualifying project developer may use up to four suc- <br /> ceeding years' suballocations as described below. <br /> (I) The yearly units allowed to be built in an affordable housing project,when added to the units in <br /> all other projects, may exceed the annual maximum limitation established in Section <br /> 17.36.060(A)of this chapter. <br /> (2) The use of up to four succeeding years' suballocations shall be allowed only if there are units <br /> available in the affordable housing suballocation for the initial year for which the approval is <br /> sought. The initial year for the affordable housing suballocation, pursuant to Section <br /> 17.36.070(B)(1)of this chapter, is 2001. No new affordable housing project shall be approved <br /> for any year which has had that year's annual suballocation totally allocated to another project <br /> except where the approval is necessary for the city to meet its affordable housing regional <br /> housing needs and the project meets the community's goals and policies, has mitigated its <br /> impacts and can be served with infrastructure and services consistent with city policies. <br /> 2. Approval Process. <br /> a. Prior Discretionary Project Approval Necessary. The qualifying project should normally have re- <br /> ceived planned unit development plan approval or design review approval prior to requesting growth <br /> management approval;however,a project may be considered for an allocation prior to such approval <br /> if sufficient information is presented to the city council for it to be able to determine the nature of the <br /> project,its affordability component,and its required allocation. <br /> b. Growth Management Approval. Following its determination that a proposed project is a qualifying <br /> affordable housing project and that there are units available in the affordable housing suballocation to <br /> allocate to it,the city council,at its discretion, may grant an allocation to the project for such year or <br /> years as it deems necessary to allow construction of the project consistent with city growth manage- <br /> ment policies.The city may exercise its discretion in determining both the size of a qualifying project <br /> as well as its phasing.The council approval shall be in the form of an affordable housing agreement. <br /> B. Major Project. A major project developer must receive a specific allocation for the number of units and years in <br /> which its project's units will be built.This allocation must be made from the suballocation for major projects. <br /> I.
