Box 520 Pleasanton, CA 94566 Recording Requested Pursuant to Government Code Sections 27383&6103 APN [insert APN] (portion) GRANT OF EASEMENT (STONERIDGE DRIVE BRIDGE - ARROYO MOCHO CHANNEL) THIS GRANT OF EASEMENT ("GRANT"), dated, 2011, is made and entered into by and between the ALAMEDA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT, ZONE 7, a body corporate and politic ("Zone 7"), and the CITY OF PLEASANTON, a municipal corporation ("City"). RECITALS A. Zone 7 owns, in fee, and maintains that certain real property in the County of Alameda, City of Pleasanton commonly known as the Arroyo Mocho Channel, ("Channel"). B. City has plans to extend Stoneridge Drive to El Charro Road and City needs to construct two new bridges along with utilities across the Channel ("Bridge"). C. The plans prepared for the Bridge; submitted to Zone 7 on June 24, 2011 and approved by Zone 7 on July 8, 2011(Approved Plans), do not include slope protection for the areas made vulnerable to scouring from flows, or allow direct access to all areas in and around the proposed Bridge. D. City intends to maintain the Channel under the Bridge, including the areas as well as 50 feet upstream and 50 feet downstream of the Bridge. E. City intends to have roads constructed providing Zone 7 access to the Channel to mitigate the interruption of access caused by the Bridge and to grant, or cause to be granted to Zone 7, access easements for the rights to use these roads. F. City requires a perpetual non-exclusive easement over the Channel for the Bridge. G. Zone 7 desires to grant an easement to City for those purposes subject to the terms and conditions of this Grant. 1
