RESOLUTION NO. 12-502 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON:(1) GRANTING MAINTENANCE AND ACCESS EASEMENTS TO ZONE 7 AND (2) ACCEPTING A GRANT OF EASEMENT FROM ZONE 7, FOR THE STONERIDGE DRIVE BRIDGES AT THE ARROYO MOCHO CHANNEL WHEREAS, the City Council previously adopted the Stoneridge Drive Specific Plan Amendment / Staples Ranch (Res. 09-268) which included two bridges over the Arroyo Mocho; and WHEREAS, to develop the two bridges, the City and the Alameda County Flood Contract and Water Conservation District Zone 7 ("Zone 7") needed to prepare a series of easements to allow the other agency access to the bridges and Arroyo Mocho, as well as areas under the bridge, for channel and roadway maintenance; and WHEREAS, the attached three easements provide for such mutual access by the City and Zone 7, and include provisions about maintenance responsibilities previously agreed to by the parties; and WHEREAS, the attached three easements are consistent with the General Plan and the Stoneridge Drive Specific Plan, and the two bridges were considered with the Final EIR for the Stoneridge Drive Specific Plan Amendment/ Staples Ranch project. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Grants a Maintenance Access Easement and an Access Easement to Zone 7 in generally the forms attached as Exhibits A and B, respectively; authorizes the City Manager and City Engineer to approve minor non-substantive corrections; and directs the City Manager to execute these easements and have them recorded. SECTION 2. Accepts the Grant of Easement from Zone 7 in generally the form attached as Exhibit C; authorizes the City Manager and City Engineer to approve minor non- substantive corrections; and directs the City Manager to execute this easement and have it recorded. SECTION 3. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
