CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 960 <br /> <br /> AN URGENCY ORDINANCE AMENDING ORDINANCE NO. 954, <br /> SECTION 2 RELATING TO EFFECTIVE DATE <br /> <br />WHEREAS, the City Council of the City of Pleasanton adopted <br /> Ordinance No. 954 (An Ordinance Amending Title V <br /> (Vehicles and Traffic), Chapter 5 (Commercial Vehicle <br /> Regulation) by Adding Article 2 to Prohibit Overweight <br /> Vehicles from Certain Roads) on January 27, 1981; and <br /> <br />WHEREAS, Section 2 of the ordinance ordained that said ordinance <br /> will take effect thirty (30) days after its passage <br /> and adoption; and <br /> <br />WHEREAS, based on said section, Ordinance No. 954 will take <br /> effect February 26, 1981; and <br /> <br />WHEREAS, the City of Livermore has requested that the effective <br /> date of the ordinance be delayed to allow sufficient <br /> time to study the adverse environmental impacts of the <br /> ordinance, to study its potential hazards to health, <br /> ,~ safety'and welfare, and to take appropriate legislative <br /> action to avoid such injuries. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON ORDAINS <br />AS FOLLOWS: <br /> <br /> Section 1: Section 2 (Effective Date of Ordinance) of Ordinance <br /> No. 954 (Amending Title V, Chapter 5, by Adding Article <br /> 2 to Prohibit Overweight Vehicles from Certain Roads) <br /> is hereby amended to read as follows: <br /> <br /> "Effective Date of Ordinance. This ordinance shall <br /> take effect on June 26, 1981'." <br /> Section 2: Declaration of Urgency. The City Council makes the <br /> following findings of urgency: <br /> <br /> (1) The City of Pleasanton has adopted Ordinance No. <br /> 954 prohibiting vehicles weighing in excess of <br /> 16,000 pounds from using certain roads in the <br /> City of Pleasanton. <br /> <br /> (2) Said ordinance will take effect on February 26, <br /> 1981 unless its effective date is extended. <br /> <br /> (3) The City of Livermore has threatened litigation <br /> due to the potential impact on the health, safety, <br /> and welfare of its citizens unless the effective <br /> <br /> <br />
