ATTACHMENT 8 <br /> Planning Commission Hearing for P11-0731 <br /> Fence between 3647 and 3633 Glacier Court North <br /> Robert Baker-Applicant-3647 Glacier Court North <br /> In full agreement with the content of the Staff Report with only minor technical <br /> corrections. <br /> Mrs. Finks rear fence, which she shares with me, is a six-foot fence and not a five-foot <br /> fence. <br /> Rather than planting a tree in the corner where my new fence intersects with Mrs. Fink's <br /> and my rear fence, it was agreed that I would plant shrubbery that would grow tall <br /> enough to shield the fence from Mrs. Finks view. A tree is not practical that close to my <br /> swimming pool. <br /> The fence was constructed from start to finish, from removal of the old fence, <br /> consultation on the new fence configuration, agreement on that configuration including <br /> dimensions, and final approval and permit application with Mr. Pretzel. <br /> Mr. Pretzel reimbursed me for half the cost of materials. <br /> Mr. Pretzel observed the construction of the new fence from start to finish but provided <br /> no labor or labor reimbursement. <br /> At no time from start to finish of this project did Mr. Pretzel come to me and object to the <br /> height of the fence. <br /> Mr. Pretzel stated that he talked to the City about the "over-height" fence and a"Stop <br /> Work Order" was issued. I was never served with such an order. <br /> Mr. Pretzel's recent work on the base of the fence structure, removing concrete and <br /> drilling into concrete post bases which can cause them to crack, has put the strength of <br /> the fence in question. <br /> I ask that Mr. Pretzel consult with me in advance and receive my approval prior to doing <br /> any additional work or modifications to the fence and it's supporting structure. And I also <br /> ask that all such work be performed by a licensed contractor rather than by Mr. Pretzel. <br /> Mr. Pretzel's ownership rights to the fence are not equal to mine. He paid for half the <br /> material costs but none of the labor costs. He has said he has every right to cut it down. If <br /> he tries to take "15 Minutes" and cut it down I will call the police and charge him with <br /> destruction of private property. '/ ' ., <br /> I ask that Mr. Pretzel's appeal be denied.
