retail outlets. Retailers would be entitled to keep the 10 cent-per bag fee, and note any <br /> charges for bags on customers' receipts. The Ordinance takes effect on January 1, <br /> 2013 and applies to larger retail establishments except restaurants and nonprofit <br /> charitable reuse organizations. StopWaste.org staff would oversee enforcement of the <br /> Single-Use Bag Reduction Ordinance. Transactions involving assistance programs (e.g. <br /> Women, Infants, and Children programs) would not be subject to the10 cent-per bag <br /> fee, and plastic bags used to contain raw meat or produce would be exempted. The <br /> proposed Single-Use Bag Reduction Ordinance could reduce litter, and would help keep <br /> plastic bags out storm sewers and catch basins which drain into waterways and the <br /> Bay. <br /> Staff has had communication with the Chamber and other local merchants regarding the <br /> Ordinance and generally, there is acceptance of its purpose. In addition, Stopwaste.org <br /> has had a number of public meetings discussing the Ordinance. <br /> Staff is recommending the City opt-in to this ordinance because it has been generally <br /> accepted by the retail community, because it is a reasonable approach to addressing <br /> the environmental concerns with single use bags, and because it includes reasonable <br /> administrative and regulatory provisions. Unless a city takes action opting-out of the <br /> ordinance, it is assumed to "opt-in."
