THE CITY OF 13 <br /> CITY COUNCIL AGENDA REPORT <br /> pLEASANTON. <br /> February 21, 2012 <br /> City Manager <br /> TITLE: MANDATORY COMMERCIAL RECYCLING AND SINGLE-USE BAG <br /> REDUCTION ORDINANCES APPROVED BY STOPWASTE.ORG <br /> SUMMARY <br /> Two countywide ordinances, a Mandatory Commercial Recycling Ordinance and a <br /> Single-Use Bag Reduction Ordinance were approved by the Alameda County Waste <br /> Management Authority (ACWMA) Board (Stopwaste.org) on January 25, 2012 with the <br /> intent that they will assist in enabling Stopwaste.org to achieve the diversion goals <br /> identified in its Strategic Plan. The Mandatory Commercial Recycling Ordinance <br /> requires commercial businesses generating more than four cubic yards of material each <br /> week, and users of transfer stations (including the Pleasanton Transfer Station), to <br /> separate recyclables from refuse. Further, it establishes City and hauler reporting <br /> requirements and enforcement provisions, which when combined with the sorting <br /> requirements, may lead to collection rate increases. The Single-Use Bag Reduction <br /> Ordinance is intended to mitigate the negative impacts to the environment caused by <br /> bag litter. <br /> Alameda County cities have the option to opt-in or opt-out of the ordinances and to opt <br /> in at a later date. Jurisdictions electing to opt-out must adopt a resolution by March 2, <br /> 2012. This report provides background to assist the City Council with its decision to opt <br /> in or opt out of these ordinances. <br /> RECOMMENDATION <br /> 1.) Approve the resolution (Attachment A) notifying Stopwaste.org that the City will opt- <br /> out of the approved county-wide Mandatory Commercial Recycling Ordinance, <br /> Phases 1 and 2. <br /> 2.) Indicate approval for participating in the Single-Use Bag Reduction Ordinance. <br /> FINANCIAL STATEMENT <br /> It is anticipated that the proposed recommendation will increase staff work across <br /> multiple departments. The fiscal impacts associated with the proposed recommendation <br /> are considered minimal at this time. However, staff intends to begin refuse and <br /> recycling rate negotiations with Pleasanton Garbage Service (PGS) that will clarify the <br /> impact of the Mandatory Commercial Recycling Ordinance. <br />
