certain timeline commitments which staff will need to meet, but no firm deadlines exist now other than <br /> those associated with the settlement agreement. <br /> Councilmember McGovern questioned why very low and low senior housing units at Kottinger were not <br /> included in the acreage figures. She pointed out that this shows the City has a broad perspective of <br /> trying to meet affordability needs in the community and asked if there is a way to make some changes <br /> to the recommendation. Mr. Dolan stated that these were not included in the new rezonings because he <br /> believes they have already been counted it in the base figures. Mr. Fialho added that a certain amount <br /> of properties are currently zoned and the City has acquired new land. The Regalia house is zoned <br /> Public Institutional and the combination of the two properties is about 2.5 acres. Staff did not include it <br /> on this list because the Council is going through the task force process and determining whether it still <br /> wants to do this which is a decision to be made, and this was not part of the public dialogue. However, <br /> staff can go back between now and the time the Planning Commission and City Council hear it and <br /> evaluate whether this gets added as additional acreage for rezoning to meet that need. <br /> Councilmember McGovern said she thinks it is important to show HCD that the City is not only looking <br /> at multi-family but also senior housing to support the goals. Mr. Fialho said the Council should be <br /> mindful that the City has met the 30 units to the acre with this recommendation. It would be whether or <br /> not the acreage they are rezoning on the Kottinger side fits some other density requirement, like 20 <br /> units or 16 units to the acre and, if it is income-restricted, whether it could meet the low and very low <br /> requirements. <br /> Councilmember Cook-Kallio questioned and confirmed that the City would receive new RHNA numbers <br /> within the next year or so. She said there is logic that numbers would be used for the next round. Mr. <br /> Dolan said whatever is left off this time will be very ripe for inclusion during the next round of RHNA <br /> numbers. <br /> Councilmember McGovern referred to the Hacienda Business Park and the Nearon site (11), stating <br /> they are constantly looking at changing zonings in the business park to residential in some cases, yet <br /> they still have not addressed the capacity issue. She asked when this would be done. Mr. Fialho stated <br /> this is a discussion the Council must have early in 2012. It is complicated because there are <br /> entitlements associated with it and it will not be prior to adoption of the Housing Element. <br /> Councilmember Thorne said the criteria list predisposes the East Pleasanton Specific Plan, and he <br /> asked how long this has been in place. Mr. Dolan said what he was describing was criteria used to <br /> make the final cut, but they have been talking about this as an issue from the beginning. <br /> Mayor Hosterman said regardless of those properties that stay on or fall off the list, she asked whether <br /> any property owner would be precluded from bringing a development application. Mr. Dolan said in <br /> some cases, they would have to ask for a rezoning, so it is a lot easier if they get it now. <br /> Mayor Hosterman opened the item for public comment. <br /> Pat Costanzo, representing the Kiewit property, voiced surprise that Kiewit was removed from the list <br /> for reasons outlined in his letter. He summarized those issues and reasons in the letter as to why they <br /> are requesting they stay on the list and suggested the City zone more than it needs. The new Housing <br /> Element is due two years from now and if 300 more units were zoned, they would roll over into that <br /> timeframe. Their site scored 25 points throughout the entire process which is the highest scoring site in <br /> the east side of Pleasanton, yet they were removed. Two items discussed were the traffic issue and the <br /> fact they were in the Specific Plan and how HCD will respond to this. When the DEIR came out, traffic <br /> was not cited as an issue. Some HCD sites clearly state, "The inventory can also include sites that are <br /> in the process of being made available for residential use via rezones or specific plans provided the <br /> Housing Element includes a program that commits the local government to completely all necessary <br /> administrative and legislative actions early in the planning period."
