Tony McCantz, Care and Associates, stated he ran a survey of the whole neighborhood. There is <br /> basically one half mile square block subdivided in 1894. When looking at all subsequent mapping <br /> around that, the worst distance he could find was a foot and two-tenths in measurement from 1894 to <br /> current, and 1894 to 1974 and then after that, everybody has been holding the 1974 measurements. <br /> There are no material discrepancies in what he is seeing in the subdivision. He was not sure where the <br /> Leuthausers home was in the mix, but from what they saw, they did not see many problems. There are <br /> a couple of monuments that are missing; one at the intersection of Courtney and Cameron, but the <br /> original one set by the tract closest to Moore is still there. Any surveyor will be able to walk his way <br /> through the entire area and square it up simply and he noted it is not a difficult area to work. <br /> Mayor Hosterman asked and confirmed that Mr. McCantz will meet or telephone the Leuthausers to <br /> ensure their questions are answered. <br /> Councilmember Sullivan suggested and clarified that staff, the consultant and the Leuthausers will get <br /> together and reconcile where the property line is. He also asked that this be a condition and that it get <br /> resolved prior to the Final Map being adopted. Mr. Fialho suggested the Council add a motion that staff <br /> work together with the two individuals to resolve this rather than tying a separate property to an issue <br /> that is with the City of Pleasanton and the property owner. The property line issue on public right-of-way <br /> or a property line issue relating to private property or adjacent private property is something that gets <br /> reconciled with the City and not as a condition of this development. Councilmember Sullivan also asked <br /> and confirmed that still will follow-up with information on the APN number of the right-of-way. <br /> Mayor Hosterman closed the public hearing. <br /> Councilmember McGovern stated her question has to do with the 5 units at Ironwood where they would <br /> be kept for 15 years at a lower rent. She said many people go into senior housing at 60 or 62 and after <br /> 15 years, they are still living there. With the units they will increase and someone move into, she asked <br /> if they could be allowed to stay there at the reduced rent until they move out. Mr. Fialho said the City <br /> actually manage the funds coming to the City and grant it in the form of monetary grants to renters. So, <br /> it is within their control of how long those monies get used and the general parameters by which they <br /> subsidize the units. Assistant City Manager Steve Bocian said the agreement calls for an extension of <br /> up to 15 years beyond the 15 years. While it could be the same person, most likely it will not be but the <br /> process is an annual one. <br /> MOTION: It was M/S by McGovern/Cook-Kallio to introduce and waive full reading of Ordinance No. <br /> 2025 approving the application of Ponderosa Homes, Carol Lehman, and William Selway for a major <br /> modification to an approved planned unit development to increase the number of lots on an <br /> approximately 19.47-acre site located at 3157 Trenery Drive and 2313 Martin Avenue from 27 lots to 31 <br /> lots; construct 29 new one-story homes from the previous combination of 25 one- and two-story homes, <br /> change the house designs and sizes, retain two existing homes and related on- and off-site <br /> modifications; as filed under case PUD-50-01M with changes and amendments to Condition 102 and <br /> 82 as discussed by the Council; waive full readings and adopt Resolution No. 11-490 approving an <br /> amendment to the Affordable Housing Agreement; and Resolution No. 11-491 certifying the Negative <br /> Declaration. Motion carried by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> 21.
