Notwithstanding that, staff does have experience operating an assisted <br /> living facility and from a private perspective, has considerable experience adopting the recent CLC <br /> project. In each of those instances, there are licensing requirements that state the threshold for <br /> acceptance in assisted living and skilled nursing facilities because, by virtue, they are supporting a <br /> certain segment of the population that is aged, has mobility issues and some disabilities that need to be <br /> dealt with in a congregate care environment. What the applicant has said is that there may be some <br /> exceptions that can be provided for individuals under the threshold age. Staff can write that into the <br /> conditions of approval, assuming that grant is provided through the Department of Social Services. <br /> Mr. Kavayiotis said he was unfamiliar with the concept of universal design, though everything would be <br /> built to ADA compliance standards. He said he would be willing to work with staff and Mrs. Rivera- <br /> Hendrickson on improving the design in this respect wherever possible. Mr. Fialho advised that the <br /> Council could advance a condition stating that staff and the applicant are required to maximize <br /> opportunities for universal design within the facility. <br /> Mayor Hosterman closed the public hearing. <br /> Mayor Hosterman said she was pleased with the design and location. <br /> In addition to the amendments relating to energy efficiency, LED lighting, and universal design, <br /> Councilmember Sullivan requested an addition to Condition No. 24 reflecting provisions for source <br /> separated refuse programs. <br /> MOTION: It was M/S by McGovern/Sullivan to approve the staff recommendation, as modified; waive <br /> full reading and adopt Resolution No 11-481 approving an amendment to the North Sycamore <br /> Specific Plan, as Files Under Case PSPA-04; introduce an waive full reading of Ordinance No. <br /> 2023 approving Planned Unit Development (PUD) Major Modification to allow a memory <br /> care/assisted living facility as a permitted use and PUD Development Plan to construct an approx. <br /> 21,481 sq. ft., 46 bed, memory care/assisted living facility at 5980 and 5998 Sunol Blvd; and <br /> waive full reading and adopt Resolution No. 11-486 approving a Mitigated Negative Declaration <br /> for the application of Nick Kavayiotidis, Petra Realty Investor, Inc., as filed under Case PSPA-04 / <br /> PUD-65-01 M. Motion carried by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br /> 11. Consider a resolution accepting the 2010-11 FY Year-end Financial Report and amending the <br /> 2010-11 FY Operating Budget <br /> Finance Director Emily Wagner reviewed the 2010-11FY ending June 30, 2011. She stated that the <br /> General Fund, which started the year with a $25.3 million in reserves, experienced actual revenues and <br /> expenditures that were $1.7 million greater and less than anticipated, for a total of $3.5 million in <br /> excess funds. Revenue increases can be attributed primarily to sales tax, property tax and <br /> development services fees. Expenditures were $1.5 less than budgeted in the areas of materials, <br /> supplies and services, utilities, contract services, and professional services. The General Fund <br /> contingency, which is typically approximately $250,000, went unspent to the tune of $200,000. <br /> Staff recommended that the Council approve additional budget amendments to utilize these additional <br /> funds as follows: (1) Establishment of a PERS Stabilization Fund for funding additional annual <br /> payments that are needed to offset the impact of smoothing or negative amortization of the City's <br /> Unfunded Pension Liability by PERS in the amount of $1,000,000; (2) Additional funding for the Self <br /> Insurance Fund for future insurance liabilities and claims.
