CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 956 <br /> <br /> AN ORDINANCE AMENDING SUBSECTION 2-5.38(e) (SIDE AND <br /> REAR YARDS: REQUIREMENTS AND EXCEPTIONS), ARTICLE 3 <br /> (SITE, YARD, BULK, USABLE OPEN SPACE AND SCREENING AND <br /> LANDSCAPING REGULATIONS), CHAPTER 2 (ZONING),TITLE II <br /> (.ZONING AND DEVELOPMENT) OF THE ORDINANCE CODE OF THE <br /> CITY OF PLEASANTON REGARDING REAR YARD SETBACK <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Subsection 2-5.38(e) (Side and Rear Yards: Requirements <br /> and Exceptions), Article 3 (Site, Yard, Bulk, Usable Open <br /> Space and Screening and Landscaping Regulations), Chapter 2 <br /> (Zoning), Title II (Zoning and Development) of the Ordinance <br /> Code of the City of Pleasanton is amended in its entirety to <br /> read as folrows: <br /> <br /> "(e) At the time of intitial construction, principal <br /> structures in the R-1-8500, R-1-7500, R-1-6500 <br /> and RM-4000 Districts may encroach into otherwise <br /> required rear yards to within fifteen (.15) feet <br /> of the rear lot line provided that there remains <br /> a single unobstructed open space with an area equal <br /> to 120% of the area obtained by multiplying the <br /> required rear yard dimension by the minimum lot <br /> width prescribed for these zoning districts. This <br /> unobstructed open area may be located in a side yard <br /> and/or in the area between the principal strucutre <br /> and the rear lot line and shall have a minimum <br /> dimension of not less than fifteen (15) feet. <br /> <br /> Additions to principal structures in the R-1-8500, <br /> R-1-7500, R-1-6500 and RM-4000 Districts may <br /> encroach into otherwise required rear yards to <br /> within fifteen C15) feet of the rear lot line <br /> provided that there remains a single unobstructed <br /> open space with an area equal to 80% of the area <br /> obtained by multiplying the required rear yard <br /> dimension by the minimum lot width prescribed for <br /> these zoning districts. This unobstructed area <br /> may be located in a side yard and/or in the area <br /> between the principal structure and the rear lot <br /> line and shall have a minimum dimension of not <br /> less than fifteen (15) feet. <br /> <br /> No structure referred to in the Section projecting <br /> into the required rear yard shall exceed one <br /> story in height." <br /> <br /> <br />
