THE CITY OF ('� <br /> - -- CITY COUNCIL AGENDA REPORT TV( <br /> pLE ASANTONo <br /> January 17, 2012 <br /> February 7, 2012 <br /> Community Development <br /> Planning Division <br /> TITLE: P11-0709/P11-0717, CONSIDERATION OF AN APPEAL OF THE <br /> PLANNING COMMISSION'S APPROVAL OF A DESIGN REVIEW <br /> APPLICATION TO REPLACE THE APPROXIMATELY <br /> 482-SQUARE-FOOT, SINGLE-STORY HOUSE LOCATED AT 205 NEAL <br /> STREET WITH AN APPROXIMATELY 1,844-SQUARE-FOOT <br /> TWO-STORY RESIDENCE AND FOR VARIANCES FROM THE <br /> PLEASANTON MUNICIPAL CODE TO: (1) REDUCE THE FRONT YARD <br /> SETBACK FROM THE REQUIRED 23 FEET TO 20 FEET TO <br /> ACCOMMODATE THE NEW HOUSE; (2) ALLOW ONE REQUIRED OFF- <br /> STREET PARKING SPACE TO BE LOCATED IN THE REQUIRED FRONT <br /> YARD SETBACK; AND (3) ALLOW TANDEM PARKING <br /> APPELLANTS: Brian and Christine Bourg <br /> APPLICANTS/ <br /> PROPERTY OWNERS: Dave and Francine Cunningham <br /> SUMMARY <br /> Brian and Christine Bourg are appealing the Planning Commission's approval to allow the <br /> replacement of the 482-square-foot, single-story house with an approximately <br /> 1,844 square-foot, two-story residence that requires three Variances from the Pleasanton <br /> Municipal Code (PMC). The Bourg's believe that the proposal violates the Downtown <br /> Specific Plan and Downtown Design Guidelines. As stated in the Bourgs' letter of appeal, <br /> they believe the proposal: (1) is out of scale with the site because it requires three <br /> Variances; (2) doesn't fit with the character of the "historic neighborhood"; (3) is a <br /> detriment to the neighborhood because it has the appearance of a condominium or <br /> townhouse due to its scale and massing; and (4) would set a "very bad" precedent for the <br /> demolition of other small cottages in the downtown area. The Bourgs' explanation of <br /> appeal is provided in Attachment 2. <br /> PLANNING COMMISSION ACTION <br /> Approved the application subject to the conditions of approval in Attachment 1 by a <br /> 4-1 vote. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt the attached draft resolution denying the <br /> appeal, thereby upholding the Planning Commission's approval of P11-0709 and <br /> P11-0717 subject to the conditions listed in Attachment 1. <br />
