Councilmember Sullivan referred to Condition #21 about trash and refuse containers. He asked if the
recycling containers also included green or food waste bins, especially given the fact it is a restaurant.
Mr. Dolan said it does, but staff can further clarify this.
Councilmember Sullivan referred to Condition #25, the State of California Model Water Efficient
Landscape Ordinance and noted that the City has adopted the Bay Friendly landscape guidelines. Mr.
Dolan said this is more difficult and aggressive than what the City was using in the past. There is no
reason they cannot apply both. Councilmember Sullivan suggested that it would be interesting to see
some analysis of this ordinance as compared to the larger guidelines.
Councilmember McGovern said in the past when alcohol was served in restaurants, there was a
condition that those who are servers and bartenders have special training, and Mr. Dolan said there are
a separate set of conditions that only apply to the use permit. Alcohol is approved under Use Permit
approval, which is separate from the PUD and this is included as a requirement.
Mayor Hosterman opened the public hearing. There being no speaker she closed the public hearing.
MOTION: It was M/S by Sullivan/Cook-Kallio to waive full reading and adopt Resolution No. 11-485
extending a conditional use permit, as filed under Case PCUP-182, for two years to expire on August
16, 2013 and introduced and waived full reading of Ordinance No 2024 approving the application of
Arpad Nagy for a PUD Major Modification, as filed under Case PUD-93-02-10M. Mr. Fialho commented that the Civic Arts Commission is working with the Harrington's monthly on
this program and this could be referred to that commission to work on. Councilmember McGovern
suggested the Gallery at the Firehouse Arts Center hold a Salute to Youth at least once a year.
COUNCIL REPORTS: None
ADJOURNMENT: There being no further business, the meeting was adjourned at 7:52 p.m. The
Council extended a tribute to our nation's men and women serving in the military.
