CITY COUNCIL OF THE CITYOF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 953 <br /> <br /> ORDINANCE AMENDING TITLE IV (HEALTH, SAFETY, MORAL <br /> AND GENERAL WELFARE), CHAPTER 2 (SPECIAL PERMITS), <br /> ARTICLE 7, (CARD ROOMS) REGARDING NUMBER OF PERMITS <br /> AND PROVIDING FOR URGENCY ADOPTION THEREOF <br /> <br />WHEREAS, the operation of card rooms attracts gamblers and <br /> bettors from outside of the cormunity, increases the <br /> potential for police problems, encourages gambling by <br /> many who can least afford it, contributes heavily to <br /> police work load during nighttime hours when police <br /> surveillance is severely limited (thereby reducing the <br /> police services in other areas of the city), and is <br /> a nuisance to neighboring uses; and <br /> <br />WHEREAS, the operation of card rooms has been reviewed several <br /> times by the City of Pleasanton, at which times the <br /> recommendation from the police department and other <br /> staff has been to eliminate card rooms as legal uses <br /> because of the adverse effects such operations have on <br /> the community, but at which times the City Council has <br /> adopted regulations which prohibit any additional card <br /> rooms in the City while allowing the two existing card <br /> rooms to remain in operation; and <br /> <br />WHEREAS, the existing ordinance allows two card room permits in <br /> the City, the number of card rooms in existence upon <br /> adoption of the ordinance, so as to not allow any expan- <br /> sion of card rooms but also to not require abatement of <br /> uses then lawfully in existence; and <br /> <br />WHEREAS, one of the two card room permits has lapsed and the card <br /> room is not presently in operation; and <br /> <br />WHEREAS, the intent of the existing card room ordinance is to <br /> prohibit any new card rooms in the City, allowing only <br /> those in existence to remain so; and <br /> <br />WHEREAS, amending the ordinance by reducing the number of allowable <br /> permits to one is consistent with the spirit of the <br /> ordinance itself by limiting the number of permits to <br /> the number of card rooms in existence, there being only <br /> one card room currently operating in the City; and <br /> <br />WHEREAS,~'~mending~he ordinance once a card room has ceased legal <br /> operation abates the use without the necessity for <br /> forcing existing uses to cease operation immediately or <br /> after an amortization period; and <br /> <br /> <br />
