CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 03-067 <br /> <br />RESOLUTION CONDITIONALLY ACCEPTING FOR PUBLIC ACCESS PURPOSES <br />AN EMERGENCY VEHICLE ACCESS AND ACCEPTING A PUBLIC SERVICE <br />EASEMENT BETWEEN THE SOUTHERN BORDER OF TRACT 7372 AND <br />ALISAL STREET/HAPPY VALLEY ROAD <br /> <br />WHEREAS, <br /> <br />as provided for in the Happy Valley Specific Plan, adopted by the Pleasanton City <br />Council in June 1998, the City, between the southern border of Tract 7372 and <br />Alisal Street/Happy Valley Road, is constructing an emergency vehicle access and <br />installing public utilities; and <br /> <br />the Happy Valley Specific Plan provides that this emergency vehicle access may <br />be used for temporary public access to the golf course and to the properties within <br />Tract 7372 pending the construction of the "Bypass Road"; and <br /> <br />WHEREAS, so that the lots within Tract 7372 are not landlocked, the City needs to accept for <br /> public access purposes the emergency vehicle access; and <br /> <br />public access to Tract 7372 and to the golf course/open space on the emergency <br />vehicle access is intended to be temporary until the Bypass Road is constructed <br />and is open to the public. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />RESOLVE AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Accepts conditionally for public access purposes the emergency vehicle access <br />between the southern border of Tract 7372 and Alisal Street/Happy Valley Road <br />as depicted on the attached Exhibit A. <br /> <br />Section 2: <br /> <br />Accepts for public utility purposes a public service easemem between the <br />southern border of Tract 7372 and Alisal Street/Happy Valley Road as depicted on <br />the attached Exhibit A. <br /> <br />Section 3: <br /> <br />Public access on and to the emergency vehicle access is limited and temporary <br />until the Bypass Road is constructed; once the Bypass Road is constructed, public <br />access on and to the emergency vehicle access will be prohibited (except for <br /> <br /> <br />
