would be applied consistently with new development. Councilmember Sullivan asked that this be
included as a condition, and Mr. Dolan agreed a condition could be added.
Councilmember Sullivan referred to Condition #21 about trash and refuse containers. He asked if the
recycling containers also included green or food waste bins, especially given the fact it is a restaurant.
Mr. Dolan said it does, but staff can further clarify this.
Councilmember Sullivan referred to Condition #25, the State of California Model Water Efficient
Landscape Ordinance and noted that the City has adopted the Bay Friendly landscape guidelines. Mr.
Dolan said this is more difficult and aggressive than what the City was using in the past. There is no
reason they cannot apply both. Councilmember Sullivan suggested that it would be interesting to see
some analysis of this ordinance as compared to the larger guidelines.
Councilmember McGovern said in the past when alcohol was served in restaurants, there was a
condition that those who are servers and bartenders have special training, and Mr. Dolan said there are
a separate set of conditions that only apply to the use permit. Alcohol is approved under Use Permit
approval, which is separate from the PUD and this is included as a requirement.
Mayor Hosterman opened the public hearing. There being no speaker she closed the public hearing.
MOTION: It was M/S by Sullivan/Cook-Kallio to approve PUD-50-01M, Ponderosa Homes, Carol
Lehman, and William and Kathryn Selway — Consider a Major Modification to the Planned Unit
Development to increase the number of lots on an approx. 19.47 acre site at 3157 Trenery Dr. and
2313 Martin Ave. from 27 to 31; to construct 29 single-story homes from the previous combination of 25
homes, to change the house designs and sizes; on/off site modifications; amendment to the low-income
housing agreement; and certify the Negative Declaration for said project, as revised to provide
clarification on additional conditions. Motion carried by the following vote:
Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman
Noes: None
Absent: None
MATTERS INITIATED BY COUNCIL
Vice Mayor Cook-Kallio asked if the City Council would support the idea of putting Karen Allen in
contact with those who could facilitate public art with young people and also have a parallel track to
also support public art seen at the Firehouse Arts Theater and the foundation the Harrington's have put
forth. Mr. Fialho commented that the Civic Arts Commission is working with the Harrington's monthly on
this program and this could be referred to that commission to work on. They meet monthly and it is a
public meeting. Councilmember McGovern suggested the Gallery at the Firehouse Arts Center hold a
Salute to Youth at least once a year.
COUNCIL REPORTS - None
ADJOURNMENT: There being no further business, the meeting was adjourned at 7:52 p.m. The
Council extended a tribute to our nation's men and women serving in the military. We wish to honor the
memories of those who have died in past wars in defense of our country, including those who have died
in the current conflicts in Iraq and Afghanistan.
Respectfully submitted,
Karen Diaz
City Clerk
City Council Minutes Page 5 of 5 November 15, 2011
