THE CITY OF 13 <br /> -- "' CITY COUNCIL AGENDA REPORT <br /> pLEASANTONo <br /> January 10, 2012 <br /> Community Development <br /> Planning Division <br /> TITLE: P11-0664, CONSIDER AN APPEAL OF THE PLANNING <br /> COMMISSION'S DENIAL OF AN APPEAL OF AN ADMINISTRATIVE <br /> DESIGN REVIEW APPLICATION TO RETAIN THE EXISTING FENCING <br /> ALONG THE REAR AND SIDE YARDS, MEASURING UP TO SEVEN <br /> FEET, ONE INCH TALL, LOCATED AT 3642 CARLSBAD WAY <br /> APPELLANT: Carl Pretzel <br /> APPLICANT/ <br /> PROPERTY OWNERS: Todd Deike <br /> SUMMARY <br /> Carl Pretzel is appealing the Planning Commission's denial of his prior appeal of the <br /> administrative approval for Mr. Deike to retain existing fencing along the rear and side <br /> yards, measuring up to seven feet, one inch tall. <br /> Mr. Pretzel's explanation of appeal is provided in Attachment 2. <br /> PLANNING COMMISSION ACTION <br /> Denied the prior appeal by a 5-0 vote. <br /> RECOMMENDATION <br /> Staff recommends that the City Council adopt the attached draft resolution denying the <br /> appeal, thereby upholding the Zoning Administrator's approval of Case No. P11-0664 <br /> subject to the conditions listed in Attachment 1. <br /> FINANCIAL STATEMENT <br /> Community Development fees would apply for Planning entitlements and/or Building <br /> permits; therefore, no fiscal impact on the City is anticipated. <br /> PROJECT DESCRIPTION AND BACKGROUND <br /> The applicant, Todd Deike, received approval from the Zoning Administrator to retain <br /> the existing solid redwood fencing measuring up to seven feet, one inch tall, located <br /> along the common side property lines, across the rear of the property, and within the <br /> side yards of the property located at 3642 Carlsbad Way (Attachment 3). <br /> Previously, in 1998 new fencing was approved for the rear property line with specific <br /> conditions of approval (Attachment 7, Exhibits I and J).
