CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 949 <br /> <br /> A~] ORDINANCE AMENDING TITLE II (ZONING AND DEVELOPMENT) <br /> OF THE ORDINANCE CODE OF THE CITY OF PLEASANTON IS <br /> A~.~ENDED BY ADDING CHAPTER 14 (FLOOD DAMAGE PREVENTION) <br /> IN ITS ENTIRETY <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />Section 1. Title II (Zoning and Development) of the Ordinance <br />Code of the City of Pleasanton is amended by adding Chapter 14 <br />(Flood Damage Prevention) as follows: <br /> <br /> Article 1 <br /> <br /> Statutory Authorization, Findings of Fact, <br /> Purpose and Objectives <br /> <br />2-21.11 Statutory Authorization. The Constitution of the State <br />of California authorizes local governmental units to adopt regu- <br />lations designed to promote the public health, safety, and general <br />welfare of its citizenry. <br /> <br /> 2-21.11 Findings of Fact. <br /> <br /> (1) The flood hazard areas of Pleasanton may subject to periodic <br /> inundation which may result in loss of life and property, <br /> health and safety hazards, disruption of commerce and govern- <br /> mental services, extraordinary public expenditures for flood <br /> protection and relief, and impairment of the tax base, all <br /> of which adversely affect the public health, safety and <br /> general welfare. <br /> <br /> (2) These flood losses are caused by the cumulative effect of <br /> obstructions in areas of special flood hazards which increase <br /> flood heights and velocities, and when inadequately anchored, <br /> damage uses in other areas. Uses that are inadequately flood- <br /> proofed, elevated or otherwise protected from flood damage <br /> also contribute to the flood loss. <br /> <br /> 2-21.12 Statement of Purpose. It is the purpose of this ordinance <br /> to promote the public health, safety, and general welfare, and to <br /> minimize public and private losses due to flood conditions in <br /> specific areas by provisions designed: <br /> <br /> (1) To protect human life and health; <br /> <br /> <br />
