remove the building, including but not limited to, placing a lien against the property to cover the costs <br /> of cleaning/removal. <br /> 18. When the restaurant ceases operation and the building becomes vacant, the property or the building <br /> owner shall remove the building within one year from the date when the building becomes <br /> unoccupied. Failure to do so may result in the City taking enforcement action and placing a lien <br /> against the property. <br /> 19. Prior to the issuance of a building permit, the applicant shall implement mitigation measures as <br /> recommended in the Traffic Study, prepared by Dowling & Associates, dated "Received September <br /> 20, 2006" on file in the Planning Division, or as otherwise determined by the City Traffic Engineer. <br /> 20. Final inspection by the Planning Division is required prior to occupancy. <br /> 21. All trash and refuse shall be contained completely within enclosures architecturally compatible with <br /> the main structure. The materials and color of the enclosure walls shall match the building walls, and <br /> the gates shall be corrugated metal or solid wood. The design of the enclosures shall be shown on <br /> the plans submitted for issuance of building permits, subject to the approval of the Director of <br /> Community Development. The trash enclosure shall be sized to accommodate trash, recycling and <br /> green waste/food scrap containers. Trash containers shall be stored within the enclosure at all times, <br /> except when being unloaded. Trash enclosures which are sized to contain dumpsters with an <br /> individual capacity of 1.5 cubic yards located within five feet of unprotected building openings, <br /> combustible walls, or combustible roof eaves shall be provided with an automatic fire sprinkler <br /> system. <br /> 22. The driveway and parking area shall be surfaced with a decomposed granite material. Surfacing <br /> shall be completed before occupancy of the restaurant and shall be maintained by the property <br /> owner/operator. <br /> 23. Appliances meeting Energy Star standards shall be installed as part of the project. The proposed <br /> appliances shall be indicated on the plans submitted for the issuance of a building permit. <br /> 24. Water conservation device such as low-flow faucets, toilets, etc. shall be installed as part of the <br /> project. The devices(s) shall be indicated on the plans submitted for the issuance of a building <br /> permit. <br /> 25. The future home shall conform to the Green Building Ordinance and the State of California's Green <br /> Building Standard Code, "CALGreen" at the time of issuance of a building permit. <br /> Landscaping <br /> 26. The project shall comply with the State of California's Model Water Efficient Landscape Ordinance for <br /> water conservation and drought tolerant plants. A licensed landscape architect shall verify the <br /> projects compliance with the ordinance: 1) prior to the issuance of a building permit; and 2) prior to <br /> final inspection. The verification shall be provided to the Planning Division. <br /> 27. Trees shall be a minimum of 15 gallons in size. All shrubs shall be a minimum of five gallons, unless <br /> otherwise shown on the plans and approved by the Director of Community Development. Deviations <br /> from the approved plan shall be reviewed and approved prior to installation. <br /> 28. The project applicant shall provide root control barriers and 4-inch perforated pipes for trees near <br /> driveways and in other paved areas less than 10-feet in width, or as determined by the Director of <br /> Community Development. <br /> 29. No trees shall be removed other than those specifically designated for removal on the approved plans <br /> or tree report. The project developer shall post cash, letter of credit, or other security satisfactory to <br /> Ordinance No. 2024 <br /> Exhibit A-1 Page 3 of 12 <br />
