ORDINANCE NO. 2023 <br /> AN ORDINANCE APPROVING THE APPLICATION OF NICK KAVAYIOTIDIS, PETRA <br /> REALTY INVESTORS, INC., FOR PUD MAJOR MODIFICATION AND PUD <br /> DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD-65-01M FOR A <br /> MEMORY CARE I ASSISTED LIVING PROJECT AT 5980 AND 5998 SUNOL BLVD <br /> WHEREAS, Nick Kavayiotidis, Petra Realty Investors, Inc., has applied for Planned Unit <br /> Development (PUD) major modification and development plan to construct an approximately <br /> 21,481 square-foot, one-story memory care/assisted living facility containing 46 beds at 5980 <br /> and 5998 Sunol Boulevard; as well as an amendment to the North Sycamore Specific Plan <br /> (NSSP) to allow this type of use; and <br /> WHEREAS, while an Environmental Impact Report (EIR) was prepared and certified for <br /> the NSSP adopted in June 1992, the property at 5998 Sunol Boulevard was not part of the <br /> NSSP or its EIR; and therefore, based on the Initial Environmental Study, a Mitigated Negative <br /> Declaration was prepared for this project and was adopted by the City Council at its noticed <br /> public hearing on November 1, 2011; and <br /> WHEREAS, at its meeting of November 1, 2011, the City Council received the Planning <br /> Commission's positive recommendations for approval of the PUD major modification and PUD <br /> development plan; and <br /> WHEREAS, the City Council finds that the PUD major modification and the PUD <br /> development plan are consistent with the General Plan, the North Sycamore Specific Plan, as <br /> amended, and the purposes of the PUD ordinance based on the findings set forth in the report <br /> presented to the City Council on November 1, 2011, and information presented at the public <br /> hearing. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOESHEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves Case PUD 65-01M, the application of Nick Kavayiotidis, Petra <br /> Realty Investors, Inc., for Planned Unit Development (PUD) major modification and <br /> development plan to construct an approximately 21,481-square-foot, one-story memory <br /> care/assisted living facility containing 46 beds at 5980 and 5998 Sunol Boulevard; and subject <br /> to the conditions shown on Exhibit A, attached here and incorporated herein by this reference. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in "The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the <br /> City Clerk's Office at 123 Main Street within fifteen (15) days after its adoption. <br /> SECTION 3. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br />
