RESOLUTION NO. 11-485 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> EXTENDING A CONDITIONAL USE PERMIT, AS FILED UNDER CASE PCUP-182, <br /> FOR TWO YEARS TO EXPIRE ON AUGUST 16, 2013 <br /> WHEREAS, Arpad Nagy has applied for a conditional use permit extension (PCUP-182) <br /> and a PUD major modification to the Ruby Hill PUD Development to extend the existing <br /> approvals for two years, to expire on August 16, 2013 for an approved project <br /> (PUD-93-02-09M/PCUP-182) which consists of: (1) relocating the existing sales office building <br /> at 2001 Ruby Hill Boulevard northwesterly along Vineyard Avenue; (2) changing the existing <br /> office use to restaurant use; (3) establishing a pad location and design guidelines for a future <br /> single-family residence; and (4) a Conditional Use Permit to allow alcoholic beverage service at <br /> the restaurant after 10:00 p.m., at the property located at 2001 Ruby Hill Boulevard; and <br /> WHEREAS, zoning for the property is PUD-OS/A/LDR (Planned Unit Development- <br /> Open Space/Agriculture/Low Density Residential) District; and <br /> WHEREAS, a duly noticed public hearing was held before the City Council on November <br /> 15, 2011, at which time all pertinent testimony and documents were received; and <br /> WHEREAS, the City Council determined that the requested Conditional Use Permit <br /> approval extension allowed by Municipal Code section 18.124.100 does change the scope of <br /> the previously approved project. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Extends for two years the effectiveness of the previously approved Case <br /> PCUP-182 for a conditional use permit to allow alcoholic beverage service after 10:00 p.m., at <br /> the restaurant to be located at 2001 Ruby Hill Boulevard, subject to the conditions of approval <br /> shown on Exhibit A-2, attached hereto and incorporated herein by this reference. This <br /> extension shall lapse on August 16, 2013 unless prior to expiration the conditions set forth in <br /> Municipal Code section 18.124.100 are satisfied. <br /> SECTION 2. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on November 15, 2011. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 15th day of <br /> November 2011, by the following vote: <br /> Ayes: Councilmembers Cook-Kallio, McGovern, Sullivan, Thorne, Mayor Hosterman <br /> Noes: None <br /> Absent: None <br />
