RESOLUTION NO. 11-486 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A MITIGATED NEGATIVE DECLARATION FOR THE <br /> APPLICATION OF NICK KAVAYIOTIDIS, PETRA REALTY INVESTORS, INC., <br /> AS FILED UNDER CASES PSPA-04 / PUD-65-01M <br /> WHEREAS, at its meeting of November 1, 2011, the City Council received a <br /> proposed Mitigated Negative Declaration for the application of Nick Kavayiotidis, Petra <br /> Realty Investors, Inc. for: (1) a North Sycamore Specific Plan (NSSP) Amendment to <br /> allow memory care/assisted living facilities as a permitted use in the PUD-O (Planned <br /> Unit Development — Office) District; and (2) Planned Unit Development (PUD) Major <br /> Modification to allow a memory care/assisted living facility as a permitted use and PUD <br /> Development Plan to construct an approximately 21,481 square foot, one-story memory <br /> care/assisted living facility containing 46 beds at 5980 and 5998 Sunol Blvd.; and <br /> WHEREAS, the City Council received and reviewed the Initial Study and <br /> Mitigated Negative Declaration dated September 22, 2011 and received the <br /> recommendations of the staff and Planning Commission; and <br /> WHEREAS, a duly noticed public hearing was held on November 1, 2011 at <br /> which time the public was given the opportunity to comment on the environmental <br /> impacts of the proposed project; and <br /> WHEREAS, the City Council has reviewed the potential impacts in accordance <br /> with the applicable state and local guidelines governing the preparation of Mitigated <br /> Negative Declarations; and <br /> WHEREAS, the City Council finds that the proposed project would not have any <br /> significant adverse effects on the environment as mitigated; and <br /> WHEREAS, the City Council further finds that the proposed project will have no <br /> potential for adverse impacts on the site's wildlife. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> Section 1: Approves the Mitigated Negative Declaration for the application of <br /> Nick Kavayiotidis, Petra Realty Investors, Inc. for: (1) a North Sycamore Specific Plan <br /> Amendment to allow memory care/assisted living facilities as a permitted use in the <br /> PUD-O (Planned Unit Development —Office) District; and (2) Planned Unit Development <br /> (PUD) Major Modification to allow a memory care/assisted living facility as a permitted <br /> use and PUD Development Plan to construct an approximately 21,481 square foot, one- <br /> story memory care/assisted living facility containing 46 beds at 5980 and 5998 Sunol <br /> Blvd. <br />
