of any building permits on the subject property the <br /> developer shall enter into an agreement with the City <br /> agreeing to pay for the studies and provide the miti- <br /> gation measures when deemed necessary by the City Engineer. <br /> Assessment districts shall be used to fund construction of <br /> these noise mitigating facilities wherever found appropriate <br /> and the cost spread to properties within the districts. <br /> <br />..6. T~at building and parking minimum setbacks shall be as <br /> set forth in Section 2.2.2a-d of the Hacienda Business Park <br /> Design Guidelines dated 4/1/82 and Tables B-2 and B-3 <br /> of the Hacienda Business Park CC&Rs, attached hereto and <br /> made part of this case by reference. <br /> <br /> 7. That Section 3.3.2a of the Design Guidelines shall be used <br /> as a guide for the landscaping of the Hopyard Road public <br /> service easement and median strip, but final approval of <br /> the landscaping of those two areas shall rest with the <br /> City staff. <br /> <br /> 8. That Section 3.3.2b-d of the Design Guidelines shall be <br /> used as a guide for the landscaping of the 33 ft. to 50 ft. <br /> wide public service easements along interior project roads, <br /> but final approval of the landscaping of these areas shall <br /> take place as part of the design consideration by the <br /> City. <br /> <br /> 9. That Section 3.4.3 and 3.4.4 of the Design Guidelines <br /> shall be used as a guide for the landscaping and design <br /> of the site parking areas and side and rear yard aTeas, <br /> but final approval of the landscaping and design of these <br /> areas shall takeplace as part of the design consideration <br /> by the City. <br /> <br />10. That all signing for the project shall be submitted to the <br /> City for approval. Section 4.1 of the Design Guidelines <br /> shall be used as a guide for such signing. <br /> <br />11. That where enumerated conditions of this PUD report <br /> conflict with statements in the PUD development plan, <br /> Design Guidelines and CC&Rs, the former shall control, <br /> except that developer may impose more restrictive conditions. <br />12. That the developer realize that the development plan, <br /> Design Guidelines and CC&Rs are only guides to the <br /> development of the subject property and that where <br /> statements, tables, figures and other data within these <br /> documents conflict with City procedures, policies and <br /> codes, the City's procedures, policies and codes shall <br /> govern, except that the developer may impose more restrictive <br /> procedures and standards. <br />13. That Table B-1 of the CC&Rs shall be used as a guide <br /> for parking within the Hacienda Business Park, but that <br /> final approval of parking required shall be determined <br /> at the time of design review by the City. <br /> <br /> <br />
