THE CITY OF <br /> -- CITY COUNCIL AGENDA REPORT <br /> pLEASANTONo <br /> December 6, 2011 <br /> Community Development <br /> Engineering Division <br /> TITLE: VACATE A PORTION OF EXCESS CITY RIGHT OF WAY ON THE <br /> NORTHEAST CORNER OF OLD BERNAL AVENUE AND AUGUSTINE <br /> STREET, RESERVE PUBLIC SERVICE EASEMENT, AND QUITCLAIM <br /> THE EXCESS TO THE ADJACENT PROPERTY OWNER <br /> SUMMARY <br /> The present owner of property at 287 Old Bernal Avenue has asked that excess right of <br /> way that is adjacent to her property (as shown in Attachment 1) be vacated and deeded <br /> to her. This right of way is located at the northeast corner of Augustine Street and Old <br /> Bernal Avenue where a right of way map originally indicated a realignment of Augustine <br /> Street, requiring the need for the full right of way. <br /> RECOMMENDATION <br /> 1. Approve the attached resolution declaring as excess street right of way on the <br /> northeast corner of Old Bernal Avenue and Augustine Street and abandoning the <br /> existing Public Service Easement along the back of the right of way. <br /> 2. Approve the granting of such excess street right of way to the adjacent property <br /> owner at 287 Old Bernal Avenue, while reserving a 3' Public Service Easement <br /> along the back of new right of way, conditioned on such adjacent property owner <br /> processing a lot line adjustment. <br /> 3. Authorize the City Manager to execute a quitclaim deed and lot line adjustment <br /> map. <br /> 4. Direct the City Clerk to record the quitclaim deed, in conjunction with the lot line <br /> adjustment. <br /> FINANCIAL STATEMENT <br /> There will be no fiscal impact to the City by vacating the excess street right of way, as <br /> the property is already being maintained by the adjacent property owner. <br />
