3 <br /> ORDINANCE NO. 2024 <br /> AN ORDINANCE APPROVING THE APPLICATION OF ARPAD NAGY FOR A PUD <br /> MAJOR MODIFICATION, AS FILED UNDER CASE PUD-93-02-10M <br /> WHEREAS, Arpad Nagy has applied for a Planned Unit Development (PUD) major <br /> modification to extend the existing approvals for two years, to expire on August 16, 2013, for an <br /> approved project (PUD-93-02-09M/PCUP-182) which consists of: (1) relocating the existing <br /> sales office building at 2001 Ruby Hill Boulevard northwesterly along Vineyard Avenue; <br /> (2) changing the existing office use to restaurant use; (3) establishing a pad location and design <br /> guidelines for a future single-family residence; and (4) a Conditional Use Permit to allow <br /> alcoholic beverage service at the restaurant after 10:00 p.m., at the property located at 2001 <br /> Ruby Hill Boulevard; and <br /> WHEREAS, zoning for the property is PUD-OS/A/LDR (Planned —Unit Development - <br /> Open Space/Agriculture/Low Density Residential) District; and <br /> WHEREAS, based on the Initial Environmental Study and pursuant to Resolution No. <br /> 07-133, the City Council adopted the Negative Declaration for the proposed project at its <br /> meeting of June 19, 2007; and <br /> WHEREAS, pursuant to Municipal Code section 18.124.100 and Resolution No. 11-485 <br /> the City Council approved the application of Arpad Nagy to extend the effectiveness of the <br /> conditional use permit approval to allow alcoholic beverage service at the restaurant after 10:00 <br /> p.m.; and <br /> WHEREAS, the City Council received the Planning Commission's positive <br /> recommendations for approval of the PUD major modification to extend the approval for two <br /> years to expire on August 16, 2013; and <br /> WHEREAS, the City Council finds that the PUD major modification is consistent with the <br /> General Plan policies and the purposes of the PUD ordinance of the City of Pleasanton. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOESHEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves Case PUD-93-02-10M, the application of Arpad Nagy for a PUD <br /> major modification to the Ruby Hill PUD Development Plan to extend the existing approvals for <br /> two years, to expire on August 16, 2013 for an approved project (PUD-93-02-09M/PCUP-182) <br /> which consists of: (1) relocating the existing sales office building at 2001 Ruby Hill Boulevard <br /> northwesterly along Vineyard Avenue; (2) changing the existing office use to restaurant use; <br /> and (3) establishing a pad location and design guidelines for a future single-family residence at <br /> the property located at 2001 Ruby Hill Boulevard, subject to the conditions shown on Exhibit A- <br /> 1, attached hereto and incorporated herein by this reference. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) <br /> days after its adoption in 'The Valley Times," a newspaper of general circulation published in <br /> the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days. in the <br /> City Clerk's office within fifteen (15) days after its adoption. <br />
