CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1039 APPROVING THE APPLICATION OF R0~jjq CATHOLIC BISHOP OF OAKLAND AND DEVCON DEVELOPMENT, INC. TO REZONE APPROXIMATELY 3.9 ACRES LOCATED ON THE EAST SIDE OF SANTA RITA ROAD APPROXIMATELY 250 FT. NORTH OF ITS INTERSECTION WITH THE SOUTHERN PACIFIC TRACTS FROM "A" (AGRICULTURAL) TO THE"I-P"(INDUSTRIAL PARK) DISTRICT WHEREAS, the Roman Catholic Bishop of Oakland and Devcon Development, Inc. applied to have an approximately 3.9 acre parcel of land located on the east side of Santa Rita Road approximately 250 ft. north of its intersection with the Southern Pacific railroad tracks rezoned from the "A" (Agricultural) to the "I-P"(Industrial Park) District; and WHEREAS, based on the Initial Environmental Study indicating possible significant adverse effects on the environment a Mitigated Negative Declaration was adopted by Council on May 1t, 1982; and WHEREAS, Council received the Planning Commission's recommenda- tion for approval of the rezoning; and WHEREAS, a duly noticed public hearing was held on May 11, 1982; and WHEREAS, the City Council finds that this rezoning is consistent with the General Plan policies of the City of Pleasanton. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves the rezoning of an approximately 3.9 acre parcel of land located on the east side of Santa Rita Road approximately 250 ft. north of its inter- section with the Southern Pacific railroad tracks from the "A" (Agricultural) to the"I-P"(Industrial Park) District, subject to the conditions in Exhibit "A" attached hereto and by this reference incorporated herein. Section 2: The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the City Clerk, designating and dividing the City into zoning
