e. Following conclusion of the hearing, the City <br /> Manager shall render written findings setting <br /> forth his findings of fact, conclusions and <br /> decision. The City Manager may dismiss the <br /> proceedings, permanently revoke or temporarily <br /> suspend the business license, or order the <br /> business license to remain in effect but <br /> subject to conditions, as the City Manager <br /> deems appropriate. <br /> <br /> f. The decision of the City Manager may be <br /> appealed to the City Council within fifteen <br /> (15) days after the rendering of the City <br /> Manager's decision. The City Council may <br /> choose, in its sole discretion, to review the <br /> matter based on the findings of fact made by <br /> the City Manager without another hearing or <br /> receipt of further evidence or argument, may <br /> schedule a subsequent hearing on a de novo <br /> basis, or may schedule a limited hearing for <br /> the purpose of receiving argument and/or <br /> supplemental evidence. In making its decision, <br /> the City Council shall be bound by the <br /> findings of facts as determined by the City <br /> Manager unless a new hearing or limited <br /> hearing has been held. The City Council <br /> shall have the same powers as are given to <br /> the City Manager in subsection (e) above with <br /> respect to taking action on the matter. <br /> <br />Section 5: Section 4-8.35 of Article 1 of Chapter 8 is hereby <br /> added to read as follows: <br /> <br /> §4-8.35 Subsequent Action on Business License <br /> Requests. Violation of the provisions of this <br /> article shall be grounds for denial of any future <br /> business license authorizing the conduct of any <br /> business which includes the sale of drug para- <br /> phernalia. <br /> <br />Section 6: Adopt Article II of Chapter 8 in its entirety to read as follows: <br /> <br /> Article 2 <br /> <br /> Sale and Display of Drug Paraphernalia <br /> <br />§4-8.50 The provisions of this Article shall be additional <br /> regulation to that contained in Article 1 of Chapter 8 (Drug <br /> Paraphernalia). These provisions shall not supersede nor in <br /> any way void the provisions contained in Article 1. <br /> <br /> -3- <br /> <br /> <br />
