ATTACHMENT 1 <br /> ORDINANCE NO. XXX <br /> AN ORDINANCE APPROVING THE APPLICATION OF ARPAD NAGY FOR A <br /> PUD MAJOR MODIFICATION, AS FILED UNDER CASE PUD-93-02-10M <br /> WHEREAS, Arpad Nagy has applied for a Plenned Unit Development (PUD) <br /> major modification to extend the existing approvals for two years, to expire on <br /> August 16, 2013, for an approved project (PUD-93-02-09M/PCUP-182) which consists <br /> of: (1) relocating the existing sales office building at 2001 Ruby Hill Boulevard <br /> northwesterly along Vineyard Avenue; (2) changing the existing office use to restaurant <br /> use; (3) establishing a pad location and design guidelines for a future single-family <br /> residence; and (4) a Conditional Use Permit to allow alcoholic beverage service at the <br /> restaurant after 10:00 p.m., at the property located at 2001 Ruby Hill Boulevard; and <br /> WHEREAS, zoning for the property is PUD-OS/A/LDR (Planned -Unit <br /> Development -Open Space/Agriculture/Low Density Residential) District; and <br /> WHEREAS, based on the Initial Environmental Study and pursuant to Resolution <br /> No. 07-133, the City Council adopted the Negative Declaration for the proposed project <br /> at its meeting of June 19, 2007; and <br /> WHEREAS, pursuant to Municipal Code section 18.124.100 and Resolution No. <br /> xxx the City Council approved the application of Arpad Nagy to extend the effectiveness <br /> of the conditional use permit approval to allow alcoholic beverage service at the <br /> restaurant after 10:00 p.m.; and <br /> WHEREAS, the City Council received the Planning Commission's positive <br /> recommendations for approval of the PUD major modification to extend the approval for <br /> two years to expire on August 16, 2013; and <br /> WHEREAS, the City Council finds that the PUD major modification is consistent <br /> with the General Plan policies and the purposes of the PUD ordinance of the City of <br /> Pleasanton. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves Case PUD-93-02-10M, the application of Arpad <br /> Nagy for a PUD major modification to the Ruby Hill PUD Development Plan to extend <br /> the existing approvals for two years, to expire on August 16, 2013 for an approved <br /> project (PUD-93-02-09M/PCUP-182) which consists of: (1) relocating the existing sales <br /> office building at 2001 Ruby Hill Boulevard northwesterly along Vineyard Avenue; <br /> (2) changing the existing office use to restaurant use; and (3) establishing a pad <br /> location and design guidelines for a future single-family residence at the property <br /> located at 2001 Ruby Hill Boulevard, subject to the conditions shown on Exhibit A-1, <br /> attached hereto and incorporated herein by this reference. <br />
