The patio/terrace dining area now includes a service area. This service area is located <br /> to the right of the door to the patio/terrace dining area, and is screened from the dining <br /> area by a seven-foot high wall matching the building. <br /> Staff found that these revisions were in substantial conformance with the 2007 approval. <br /> Green Building <br /> Currently the proposed development is not subject to the City's Green Building <br /> Ordinance. However, the applicant has offered to use Energy Star appliances and to <br /> use water conservation devices such as low flow faucets, toilets, etc. as part of the <br /> project. Staff has includes conditions (conditions No. 24 and 25) to reflect these green <br /> building measures. <br /> PLANNING COMMISSION ACTION <br /> The Planning Commission held a public hearing on October 26, 2011 to review the <br /> subject application. Detailed information on this meeting is provided in the attached <br /> excerpts of the Planning Commission minutes. No members of the public spoke at the <br /> hearing concerning the subject proposal other than the applicant. <br /> DISCUSSION <br /> Staff and the Planning Commission believe that the proposed revisions are consistent <br /> with the original approval and would improve the operation of the restaurant. The <br /> kitchenette addition is small in size and the design matches the building. Given the <br /> orientation of the building, the kitchenette addition would not be very visible from <br /> Vineyard Avenue or from residential properties in Ruby Hill. Staff and the Planning <br /> Commission further believe that the modification to the basement is necessary as it was <br /> recommended by the project structural engineer to strengthen the structure of the <br /> building. Despite the revised floor plans, the number of seats at the proposed <br /> restaurant would remain unchanged. Therefore, the revisions were found to be in <br /> substantial conformance to the original approval. A detailed analysis and discussion of <br /> the proposal is included in the attached Planning Commission staff report dated October <br /> 12, 2011, and the Planning Commission Memorandum dated October 26, 2011, <br /> including a timeline of what had occurred from the time the project was originally <br /> approved to the current date. <br /> PUBLIC NOTICE <br /> Notice of the proposed extension request was sent to properties within Ruby Hill and <br /> within 1,000-foot radius of the subject site. At the time this report was prepared staff <br /> had not received any additional comments or concerns. <br /> Page 5 of 6 <br />
