THE CITY OF 14 <br /> "' CITY COUNCIL AGENDA REPORT <br /> pL£ASANTONo <br /> November 15, 2011 <br /> Community Development <br /> Planning Division <br /> TITLE: PUD-93-02-10M, ARPAD NAGY — APPLICATION FOR A MAJOR <br /> MODIFICATION TO EXTEND THE APPROVALS FOR TWO YEARS, TO <br /> EXPIRE ON AUGUST 16, 2013, FOR AN APPROVED PROJECT <br /> (PUD-93-02-09M/PCUP-82) WHICH CONSISTS OF: (1) RELOCATING <br /> THE EXISTING SALES OFFICE BUILDING AT 2001 RUBY HILL <br /> BOULEVARD NORTHWESTERLY ALONG VINEYARD AVENUE; <br /> (2) CHANGING THE EXISTING OFFICE USE TO RESTAURANT USE; <br /> (3) ESTABLISHING A PAD LOCATION AND DESIGN GUIDELINES <br /> FOR A FUTURE SINGLE-FAMILY RESIDENCE; AND (4) A <br /> CONDITIONAL USE PERMIT TO ALLOW ALCOHOLIC BEVERAGE <br /> SERVICE AT THE RESTAURANT AFTER 10:00 P.M. <br /> APPLICANT: Arpad Nagy <br /> SUMMARY <br /> In June 2007, the City Council, on a 4:1 vote, approved a PUD major modification to <br /> relocate the existing two-story building previously used as the Ruby Hill sales office <br /> from the current location northwesterly toward Vineyard Avenue. This building would be <br /> converted into a restaurant open for dinner and for private functions by reservation <br /> during non-dining hours. A new driveway would be established off Vineyard Avenue for <br /> exclusive use by the restaurant patrons, and a 100-space parking lot would be <br /> constructed along Vineyard Avenue. Alcoholic beverages would be served in <br /> conjunction with the restaurant activities. In addition, the applicant proposed a pad <br /> location for a future residence, which was the current location of the sales office. <br /> Since the 2007 City Council approval, the applicant made minor revisions to the <br /> approved plans during the plan check process. An approximately 382-square-foot <br /> addition was added to the right side of the second floor dining area of the restaurant. <br /> This area would be used as a kitchenette to prepare food before serving and to function <br /> as a service station. As a result of the kitchenette addition, a small percentage of the <br /> building's front, back and right elevations changed accordingly. Other minor changes <br /> occurred in the interior floor plan layouts and an expansion in the basement area was <br /> recommended by the project structural engineer. These revisions were supported by a <br /> group of Ruby Hill residents who live nearby the project site and who were actively <br /> involved in the project development. Additionally, these revisions were reviewed by the <br /> Zoning Administrator at that time and were found to be in substantial conformance to <br /> the original approval. Therefore, no subsequent modification was required. Approval of <br /> the building plans has since expired. <br />
