ATTACHMENT 3 <br /> CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> RESOLUTION NO. XXXX <br /> RESOLUTION ADOPTING AN AMENDMENT TO THE NORTH <br /> SYCAMORE SPECIFIC PLAN, AS FILED UNDER CASE PSPA-04 <br /> WHEREAS, Nick Kavayiotidis, Petra Realty Investors, Inc. has applied to amend the <br /> North Sycamore Specific Plan (NSSP) to allow memory care/assisted <br /> living facilities as a permitted use in the PUD-O (Planned Unit <br /> Development— Office) District; and <br /> WHEREAS, the Planning Commission conducted a public hearing on the application <br /> and recommended on October 12, 2011 that the City Council approve the <br /> amendment to the NSSP and adopt a mitigated negative declaration to <br /> address any environmental impacts; and <br /> WHEREAS, a noticed public hearing was held on November 1, 2011, at which time the <br /> City Council reviewed the proposed amendment to the North Sycamore <br /> Specific Plan and considered all related reports, documents, testimony, <br /> and recommendations; and <br /> WHEREAS, the City Council finds that no potentially significant environmental effects <br /> have been identified by the Initial Study of Environmental Impacts or that <br /> any impacts either have been mitigated by project conditions of approval <br /> or modifications made to the project during the review process; and <br /> WHEREAS, the City Council finds, based on the information in the report and <br /> testimony from the public hearing, that the adoption of the amendment to <br /> the North Sycamore Specific Plan is consistent with the General Plan. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> RESOLVES AS FOLLOWS: <br /> Section 1: Approves the application of Nick Kavayiotidis, Petra Realty Investors, Inc, <br /> Inc. to amend the North Sycamore Specific Plan to allow memory <br /> care/assisted living facilities as a permitted use in the PUD-O (Planned <br /> Unit Development— Office) District, as shown on "Exhibit C," attached <br /> hereto and made a part of this case by reference. <br />
