07 <br /> THE CITY OF • <br /> .„ CITY COUNCIL AGENDA REPORT <br /> pL£ASANTONa <br /> October 18, 2011 <br /> Community Development <br /> Engineering Division <br /> TITLE: CONSIDER REQUEST FOR A PREANNEXATION AGREEMENT AND <br /> WATER AND SEWER CONNECTIONS FOR THE TWO LOT <br /> SUBDIVISION APPROVED BY THE ALAMEDA COUNTY PLANNING <br /> DEPARTMENT (364 LINDEN WAY— SIA HASHEMI) <br /> SUMMARY <br /> The property located at 364 Linden Way is located within the unincorporated area of <br /> Alameda County known as the Remen Tract. The property owner recently received an <br /> approval from the County to subdivide the 38,400 square foot parcel into two lots with <br /> the condition that the property must connect to the City's water and sewer systems. <br /> When a property is within 200 feet of public sewer line, Alameda County Department of <br /> Environmental Health regulations require all new development utilize the public sewer <br /> system. Prior to allowing a property located within the County to connect to the City <br /> water and sewer systems, the City requires the property owner to enter into a <br /> preannexation agreement. <br /> On August 16, 2011, the City Council denied a request for utility connections for a <br /> proposed three lot subdivision on this parcel. The three lot subdivision met the County's <br /> development standards R-1-B-10 (Single-Family residence, 10,000 square foot <br /> minimum building site area); however, one of the interior lots did not meet the City's R- <br /> 1-10,000 Zoning District regulations. <br /> This two lot subdivision meets both the County and City zoning regulations. <br /> RECOMMENDATION <br /> 1. Authorize connection of Parcel Map 9920, two lot subdivision located at 364 Linden <br /> Way to the City sanitary sewer and water systems, provided: all connection work is <br /> done to the satisfaction of the City Engineer; all costs are borne by the property <br /> owner; and the proposed extension of City services is approved by the Alameda <br /> County Local Agency Formation Commission (LAFCo). <br /> 2. Approve the preannexation agreement between Sia Hashemi and the City of <br /> Pleasanton, and authorize the City Manager to execute the agreement. <br /> 3. File an application with LAFCo for the extension of sewer and water service to this <br /> property. <br />
