07 THE CITY OF • .„ CITY COUNCIL AGENDA REPORT pL£ASANTONa October 18, 2011 Community Development Engineering Division TITLE: CONSIDER REQUEST FOR A PREANNEXATION AGREEMENT AND WATER AND SEWER CONNECTIONS FOR THE TWO LOT SUBDIVISION APPROVED BY THE ALAMEDA COUNTY PLANNING DEPARTMENT (364 LINDEN WAY— SIA HASHEMI) SUMMARY The property located at 364 Linden Way is located within the unincorporated area of Alameda County known as the Remen Tract. The property owner recently received an approval from the County to subdivide the 38,400 square foot parcel into two lots with the condition that the property must connect to the City's water and sewer systems. When a property is within 200 feet of public sewer line, Alameda County Department of Environmental Health regulations require all new development utilize the public sewer system. Prior to allowing a property located within the County to connect to the City water and sewer systems, the City requires the property owner to enter into a preannexation agreement. On August 16, 2011, the City Council denied a request for utility connections for a proposed three lot subdivision on this parcel. The three lot subdivision met the County's development standards R-1-B-10 (Single-Family residence, 10,000 square foot minimum building site area); however, one of the interior lots did not meet the City's R- 1-10,000 Zoning District regulations. This two lot subdivision meets both the County and City zoning regulations. RECOMMENDATION 1. Authorize connection of Parcel Map 9920, two lot subdivision located at 364 Linden Way to the City sanitary sewer and water systems, provided: all connection work is done to the satisfaction of the City Engineer; all costs are borne by the property owner; and the proposed extension of City services is approved by the Alameda County Local Agency Formation Commission (LAFCo). 2. Approve the preannexation agreement between Sia Hashemi and the City of Pleasanton, and authorize the City Manager to execute the agreement. 3. File an application with LAFCo for the extension of sewer and water service to this property.
