CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1093 <br /> <br />AN ORDINANCE AMENDING PROVISIONS OF THE BUSINESS <br />LICENSE AND GROSS RECEIPTS TAX RELATING TO EVIDENCE <br />OF DOING BUSINESS AND PENALTIES FOE LATE PA~4ENT <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Section 1-5.20 of the Pleasanton >~nicioal Code <br /> is hereby amended to read as follows: <br /> <br />"When any person shall by the use of signs, circulars, <br />cards, telephone books or newspapers advertise, hold <br />out or represent that he is in business in the city, <br />or when any person holds an active license or permit <br />issued by a governmental agency indicating that he <br />is in business in the city, or when any person makes <br />a sale, takes an order, renders a commercial service <br />or performs any other similar act within the city, <br />and such person fails to deny by sworn statement <br />given to the Collector that he is not conducting <br />business in the city after being requested to do so <br />by the Collector, then these facts shall be considered <br />prima facie evidence that he is conducting a business <br />in the city." <br /> <br />Section 2: The first sentence of Section 1-5.35 is amended to <br /> read as follows: <br /> <br />"For failure to pay a license tax when due, the <br />Collector shall add a penalty of 5% of said license <br />tax on the first day of each month after the due <br />date thereof, providing that the amount of such <br />penalty to be added shall in no event exceed 50% <br />of the amount of the license tax due." <br /> <br />Section 3: This ordinance shall be published once within <br /> fifteen (15) days after its adoption in "The Valley <br /> Times," a newspaper of general circulation published <br /> in the City of Pleasanton. <br /> <br />Section 4: This ordinance shall be effective thirty (30) days <br /> after the date of its final passage and adoption. <br /> <br />INTRODUCED at a regular meeting of the City Council of the <br />City of Pleasanton on June 28, 1983. <br /> <br /> <br />
